If you can prove gross negligence on their part then you can pierce the corporate veil. But I'm guessing it will cost quite a bit to get a successful claim.
Also its nice to hear you have a new job but just a word of advice, don't ever be loyal to a profit maximising company. They are in the business of maximising profits, and not rewarding loyalty.
Psychopaths rule corporate society and are celebrated for exactly doing this type of thing.

well we can debate principal agent relations to try and argue against profit maximisation, but in general we believe that businesses maximise profits, whats your point though?

I was reading your comment regarding, ''don't ever be loyal to a profit maximizing company''... I wouldn't work for any company that wasn't focused on maximizing profits... just my 2c.
perhaps I should have just stated never to be loyal to any company.

Your only option is approach the liquidator as a claimant - assuming the boss went into or applied for business rescue and subsequently went into liquidation.
If at CCMA - the company is claiming the business closed for operational reasons - again you are on shakey ground.
The fact you have employment - although it shouldnt matter - may count against you with the commissioner. I know its not fair, but SA politics finds its way into everything.
The LRA and BCEA wont help.
There may me something in the Companies act, but I dont think you will have any joy there.

Loyalty should work both ways, but unfortunately .... in business ....
Think of it like this .... nobody has become rich working for someone else.

Well, lots of people become rich working for others... It's wealth that evades you.
yeah but thats the point, a business is a legal entity, it cannot express loyalty, its sole purpose is to act as a vehicle for the owner to generate profit on his investment.
why show loyalty to such a model?
Ever seen bankers and portfolio managers bonuses?

I think he means those that maximise profits at all costs, nothing is sacred including exploiting staff using whatever means necessary. Everyone knows those kinds of companies, either through direct experience or via hearing from those that have been stuck in the maw of the ravenous greed monster.
Update:
Had my CCMA case this morning, employer didnt pitch.
In a nutshell the commissioner referred me to the labour court. I went to the labour court, got a case number, and all the forms, will be taking it further with them.
If this company will liquidate, this is the only avenue I have, If I want compensation.

Thats the weird, thing. No one else is doing anything else. Others that went to the CCMA, kinda just said "ah well, I guess thats it then".
I know these incompetent people already opened another business, they must be accountable for their actions in some way!!!

name and shame is one way, otherwise this is how the cookie crumbles,
the rich get richer, the poor get poorer....
if you had the cash, you could make their life difficult, by calling their customers and making their life hard,
or you could just do the next best thing, blacklist them on the net, by naming and shaming them,
Im seriously considering doing that on another company that is still advertising positions,
thought to put up their name on the IT jobs section on MYBB, and dissuade anybody from even applying.....
Oh trust me this is definitely going to happen...
