I need some legal advice please.
I handed a blackberry 9700 in at Happy Mobile at the Newlands shopping centre in Pretoria to have water damage repaired on 19 July 2012. It had a searching for network error.
I paid R700.00 for the repair and got the phone back. It worked for a few days and I took it back to them.
I have been waiting more than a month and the owner/technician keeps on telling me that the phone is ready and that I can pick it up the next day. But every day he has an excuse why it is not at the shop and tells me that I must come back the next day. I went there today and they tried to give me a phone that is not mine hoping I won't notice. When I switched it on in the shop the lcd was scratched on the inside and did not work.
He said it was a mistake and again told me it will be ready tomorrow.
The owner is not based at the shop but has a clerk who books the phones in and they get repaired in joburg somewhere.
What can I do legally to force him to bring the phone? I have a feeling he lost it.
I don't even really care if it is fixed or not, I just want it back because my whole address book and a lot of emails are still on it..
