"Unshaped" not really unshaped

Would there be a case for the ASA against Telkom for advertising their more expensive ADSL option as being unshaped when it is in actual fact not unshaped?

The fact that certain solutions can improve your ingame latency on an unshaped account should prove this (These applications usually add a bit of overhead and hence should actually increase the ingame latency slightly if the account was indeed unshaped).

you'll need more than that to prove you case. You'd need to compare something like an international leased to "unshaped",but even then there are differences.
