Just going through the process of registering for VAT and learning my way around payment process etc.

Seems to me the most basic way of sticking it to the government and starting a revolt. Small business could pay their VAT over to a properly run organisation instead of SARS.

The average man on the street who earns a salary cant really stick it to SARS as their tax is already processed before they receive their salary.

Just gets me thinking what could be done with that amount of monthly money running into an organisation like OUTA or Gift of the givers.

Tax or Vat revolt has been mentioned numerous time but as frustrating as it is Governments will always take their pound of flesh. Heard a financial advisor once joke it is easier to get away with murder than tax evasion which just shows how ridiculous the system is. An yes if Gift of the Givers was a political party they would get my vote.

VAT fraud = jail. They don't fsck around. It's not your money, you're just collecting it on their behalf. As such, it's seen as theft, which they don't like very much.

They have f0k0l problems related to these thieving politicians lining their pockets via ill-gotten gains. Would be wonderful to see them stick it to these corrupt political elites the same way they stick it to Joe Soap on the street.

I think the right to withhold tax is in the constitution. Employees must just opt for a consulting contract and do their own tax and not pay it.

They is no-way around VAT payments to SARS and fairly so..... However, they is over 1001 ways to pay other taxes that YOU think is fair. I always say say that SARS is the one shareholder out of my suppliers, customers, employees that I want to cheat.

Look at this way, you will have a cashflow float when you receive VAT till when you have to pay VAT which is 2-6 months later, this will effectively pay for the interest charges on your business expenses. On your other taxes you can really pay 10%/5% tax or have SARS give you a refund on your expenses, its best to structure your obligations to pay 2-10% tax so not to have SARS audit you, and even if they do, everything should be kosher. Now it's not illegal to pay as little tax as possible (case law from 1999) just do it legally! Consult a tax practitioner, in my eyes and the courts eyes withholding VAT without due cause is a crime, and SARS will not be kind to you if you do.

VAT payments work in your favour.

Sure, our taxes can be used more effectively maybe donations to OUTA etc etc but at the end of day, personal feelings on how taxes (VAT is not your money) will not hold water in court.

If you want a tax revolt just pay as little tax as possible, you can even "earn" yourself a good sum if you play your cards right. The point is that you can not morally/legally withhold VAT from SARS as the amounts are not yours, you can not collect 15% VAT monies from your clients and refuse to pay to SARS, under the very same act, its immoral and SARS will see to it that you get punished.

Nothing wrong with tax avoidance, it's tax evasion that's illegal.

Caselaw goes back almost centuries to confirm that you should structure your tax affairs in a way to pay as little as possible. Legally.

Not declaring is illegal. Many ppl don't really know the law well or bother highering a good consultant which could save them a good sum of money.

Any one may so arrange his affairs that his taxes shall be as low as possible; he is not bound to choose that pattern which will best pay the Treasury; there is not even a patriotic duty to increase one's taxes.

Gregory v. Helvering, 69 F.2d 809, 810 (2d Cir. 1934)

Over and over again courts have said that there is nothing sinister in so arranging one's affairs as to keep taxes as low as possible. Everybody does so, rich or poor; and all do right, for nobody owes any public duty to pay more than the law demands: taxes are enforced exactions, not voluntary contributions. To demand more in the name of morals is mere cant.

Commissioner v. Newman, 159 F.2d 848, 851 (2d Cir. 1947) - dissenting opinion
