I think somewhere on the telkom contract. It says it has the rights to appoint an arbitrator in the case of a dispute, and you can only take legal action against them once the arbitration has failed.

but the SA constitution says you have the right to be Heard in a court of Law
 
There is no such thing... You can choose not to follow Telkom's complaints procedure (which can include arbitration, but does not require it).

Going this route may not be in your favour, but you need to give them a reasonable oportunity to remedy the breach.

There is certainly nothing stopping you from taking them to court right off the bat and going for a summary judgement.
They can declare a dispute and request arbitration, but there is nothing that says you must submit to arbitration.

This case was in a small claims court. They exist to keep the costs down for smaller cases.
