Vet killed my dog

I moved to the Netherlands a while ago, I couldn’t bring my Great Dane with me. My parents adopted him, he adored them and they treated him like an honorary grandson. Couldn’t have found a better match.

On Thursday evening, I got a phone call from my mother - utterly beside herself, struggling to speak due to the grief of watching the dog suffer.

He had collapsed in the garden, my mother went looking for him after he didn’t return from going outside after approximately 30 minutes. She reported that he was on his side in a flower bed retching and visibly in extraordinary pain.

I told her it sounded like GDV and they had to get him to a vet ASAP. So they called an animal ambulance service.

Dog was taken to a 24/7 animal hospital, where they confirmed it was GDV.

The vet informed my parents that they would stabilize Dog and then proceed to operate in the morning. At this point the cost was just over R10,000.

in the morning the vet updated us, said Dog was stable but recommended that they perform an operation to attach Dog’s stomach in such a way that GDV would not reoccur- this would cost R25,000.

We approved the operation, not wanting this to happen again.

A while later, we were updated that the operation was successful but there was a complication due to a “birth defect” with Dog.

The vet said they had to place Dog on his back for the operation and afterwards he was not able to walk (without absolutely excruciating pain) because of a “birth defect” in his spine.

Just note - Dog has been happy and healthy for years. He had gone to the same animal hospital for years, he even had puppy school there. After numerous checkups over the years at this same practice- none of the vets ever pointed out a “birth defect”. Additionally, Dog had been on his back many, many times without issues or complaints of pain; for play and belly rubs, etc.

The vet proceeded to tell my parents that they would monitor him for a day and requested an additional R2000 to cover the stay. Again, we approved.

During this time, my parents did visit him- Dog was being kept in a relatively tiny cage in which he could not turn around (if he was able).

Another note- it seems patently absurd to me that an actual animal hospital which boasts advanced healthcare like CT scans does not have the facilities to adequately house a large dog… they said a 70KG dog was an “exceptional case”.

At this point, Dog was being given morphine to manage the pain. The vet called my parents to pick him up earlier this (Saturday) afternoon.

Upon arriving at the vet to pick him up- Dog was covered in horrific red rash, the vet told us the rash was due to “Dog being given the wrong antibiotics”… in the vet’s own words. Dog was also bleeding from his joints, likely from being scraped on the floor…

My parents were livid but happy to take him home, away from that place. Dog barely made it to the car, his back legs no longer functioned correctly.

Once they arrived home, Dog collapsed on the concrete floor outside the house and could not move.

My parents tied to offer him food, a cooked chicken, chicken broth, biltong, treats, dog food, etc. he responded to nothing besides water- which he drank copious amounts of (almost as if he wasn’t given any at the vet).

After waiting, the sun started to set and Dog was lying in the same spot outside in the cold. My mother placed blankets on him, but he was unresponsive.

They tried to get him to stand up to take him to another vet, but he wouldn’t- at any point.

He had to be put down, he died about 2 hours ago. A van had to come with a vet to sedate Dog so they could move him.. I watched him die via a WhatsApp call…

Dog did not have any issues with his back/spine- he did not exhibit any symptoms of any problems, nor has any vet ever indicated that there was a problem. I do, therefore, not believe this was at all due to a “birth defect”. Furthermore, the condition which led to his death was not related to his stomach- not remotely.

I believe the fault is with the vet and whilst I am utterly defeated and destroyed that my dog is dead- I do not want my parents to have to pay 35k+ to a vet that killed my dog… is there anything we can do?

And he could end up losing the case, it could just be me but I feel his grief is getting in the way.

If he died as a result of complications due to things such as anesthesia or issues with his stomach- then I’d accept the outcome.

But what happened to Dog is like going in for stomach ulcers and coming out a paraplegic. And to top it off, being treated poorly in other regards (such as being given the wrong medication for your ailment.

Surgery is risky, but we don’t define absolutely all outcomes as “oh well, things happen in surgery”… the concept of malpractice can and I believe does apply in this case.

If this was a human, we’d look to recover damages… in this case, however, I just don’t believe it’s appropriate to pay for what’s happened to Dog. Nothing that was done to him is okay, from his lodgings, his antibiotics to the pain caused and damage to his spine.
 
35K to kill your dog. Nah. This sounds like they screwed up massively. But our court system is a mess.
I don’t think courts are an option, there is the risk of losing and yeah… it just seems so wrong to pay the practice that killed my dog in the way they killed my dog.

Dog’s last moments were excruciating, and the pain had nothing to do with the problem he went to the vet for..

I was hoping there would be an ombudsman or something? Maybe a medical board or something?

I am hurt and heartbroken by what happened to Dog but I’m not seeking vengeance- I just don’t want to see the vet get paid for this atrocity.
 
I honestly don't see how courts are not going to be an option if there is a dispute. I know nothing about dogs and won't comment about the medical procedures that led to the death of the dog.

From a legal perspective, you might be having your views about how the whole thing unfolded, the Vet will also also have their views, if there is a stalemate then courts are going to be an arbiter.
Problem is even if there was some wrongdoing on the side of the Vet they are not going to admit it, the least that could happen is them waiving the fees in "good faith/goodwill" and both of you going your seperate ways.

My advice to you would be to find another way besides the "Vet killed my dog" approach if you are planning to resolve this amicably without the courts, simply because I don't see the Vet admitting to killing the dog and I totally don't see them taking kindly to it either.

State your case to them, in a calm manner articulating your position on the events and hear what they say.
 
Sue them for malpractice.

First step is to find similar cases.

Sorry for your loss it must be terrible, but it does sound like that vet milked it without doing due diligence.
 
Just to add, be careful that whatever you say or do from now with the Vet could have legal implications so don't do anything in haste, good thing you are looking for advice.

Make sure you and your parents are on the same page with what happens from now and it would be preferable if only one person handles all the communications so that there aren't any parallel processes happening.
 
I've got tears in my eyes here for you and your family OP.
This is terribly heart breaking.

I wouldn't be able to offer any direction to take that'd be prudent. But the fact that the vet admitted to incorrect antibiotics, must mean something right?

Oh my hell, I'd lose my mind.

All the symptoms you described happened to my dog, it also came on quickly in a matter of just a day or two the dog went from super happy to everything you mentioned. The thirst issue is the first and biggest sign of some sort of kidney failure.

Did the VET or your parents do a breath test at all ? If you could smell a sort of urine foul smell from his mouth its a clear sign of kidney failure.

Regarding the VET bill, I do believe if we had any sense of just society there would be some sort of clause that nullifies a bill of any kind if the animal happens to die during or related to medical procedure. The fact this is not written into law opens up far too many negligent avenues for VETS who knows they will be able to collect the bill even if the dog dies shortly after and in case of animals they cannot divulge to the owners verbally after the surgery that the VET fkd up so its such a easy negligent way of making money if the VET is not absolutely on your side.

Sorry for your loss. It must have been harrowing.

I hope I don't sound callous but at that age though I'm not sure I would have put him through the ordeal of even the first surgery, let alone the second op.

How long a wait was that? I'm surprised they didn't want to operate immediately.

I suppose a lawyer would be your next step and an autopsy to determine the exact cause of death.
 
So sorry for your loss. A horrific story. On the matter of the vet and malpractice and civil litigation etc, I would advise to walk away unless you have more money to throw at this. if they vet has a CT scanner they have expensive attorneys. Not sure if there is a Vet council or anything but maybe report the vet there, also have a polite word with the Vet on this. Maybe they are rational.

There sadly isn't, though this bill seems really excessive.
 
This sucks, so sorry it happened :mad:

The problem with dogs are that they are seen as property. Its best to talk to a lawyer but IMO replacement of the property will probably be as far as you can get and maybe a slap on the wrist from someone like SAVC for the vet.

Vets are unregulated they are more expensive than doctors in most cases. They also know how to play on peoples emotions.
