Vodacom: Breach of Contract

Breach of Contract:

1) Location: Durban/Hillcrest/Summerveld
2) Time of issue: Since 8 May 2012
3) Device: Vodafone mobile broadband data
4) Contract Type (pre-paid, contract, hybrid): Contract
5) Existing reference numbers from 155: is OOTD-DOX2
6) speed.vodacom.co.za results (if possible): NA
7) Cell number under discussion: 0764006482

I recently got a new Vodafone mobile broadband data contract with Vodacom. Vodacom stated on their website that there is 3G coverage in the area (Durban/Hillcrest/Summerveld)
There is no 3g coverage, the only coverage I get is edge and that is interrupted as well. I have reported this to the customer care (10 May 2012) on more than one occasion (one reference number is OOTD-DOX2). I have reported this on the Hello Peter www site, Vodacom responded that somebody will contact me, I did receive and sms, but a sms does not solve my problem. I am still waiting for Feedback from VODACOM

You're going to have to prove that a lack of 3G coverage constitutes a breach of contract :)

Reception/coverage cannot be guaranteed in all areas due to interference, either geographically or due to infrastructure, be this other signals in the area, or due to buildings.

not quite true... if i publish a map showing where it will be, and tell people "check the map before you sign up" the map should indicate the space where they are comfortable providing the product. Areas 'around the edges of the map' can also have signal but because of interference its to a weak signal to qualify to get on the map.

If it happen in your house in the middle of the 3g zone on the map, there is no signal, Vodacom will, (from personal experience), and should provide you a 3G booster to get signal to you, or simply cancel the contract no questions asked.
 
When I lived in the Eastern Cape I took out a 3G contract. I relocated to JHB & the complex where I am in has bad 3G signal. If I got 1 or 2 floors up the signal is really good but I lived on the ground floor.

I called them & complained about it & they asked me what I wanted from them. I told them to sort their sh|t out or cancel my contract. At first they were resistant but after a few calls and a few days of escalation & bugging them my contract was cancelled free of charge.
 
Thanks for all your replies, something must have worked, either Hello Peter or this forum. After 2 weeks Vodacom called me back, they reset the tower, and there was light, I can work again.

I am happy for you that all was resolved but wish to offer a method of complaining for future use.
  • Call 082155 for Data issues.
  • Call 082111 for other than Data issues.
  • Send a Email to [email protected].
  • Send a PM(Personal Message) to 'VodacomData' the Vodacom Rep on this forum.
  • Also try sending a PM to 'OCleroux' he will also assist if able to.
These steps are by far more efficient than HelloPeter.:D

The CPA has a clause about the goods being "fit for purpose" which is why on the contract you fill in a block saying what you want the device / contract for. This is usually written in as "accessing the Internet" on a data contract, and that is actually how you would get a contract cancelled, not breach of contract.

Lack of coverage is not breach of contract - the coverage maps all have disclaimers on stating that local conditions vary and besides they're all based on an outdoor signal. In any case coverage is almost always viewed as a best effort, not a promise or a guarantee.
