11 Aug 2006
Mr Mudde, lodged a consumer complaint against a Vodacom advertisement that was featured in The Star newspaper on the 30 June 2006.
The advertisement states, “SMS TO WIN ONE OF 4 AUDI A3’s” and “Simply SMS ‘Vodacom Challenge’ to 33450 to win one of 4 brand new Audi A3’s!”
It also states, “SMS’s are charged at R1,50. Terms and conditions apply”.
COMPLAINT
In essence, the complainant submitted that the advertisement is misleading as there are additional costs and complexities involved when attempting to enter the competition.
The reasonable consumer would believe that to enter the competition would require just one sms message to be sent. In actual fact, the user is required to send further sms’s at R1,50 each to successfully enter the competition.
