Vodacom Contract, Nashua messing around!

Hi All

I have been with Vodacom (via Nashua Mobile) for 8 years now. At the end of my last contract they gave me my upgrade after 20 months (May 2006) and not the typical 22 months.

Now I am (should be) due for an upgrade again but they want me to wait until Aug 2008, the original 22 months from contract start date. BUT this leaves me with a phone that is now 25 months old and will only be replaced when it is 27 months old!

The T&C I read states: If you have not upgraded your phone in the past 24 months, you are ellegable for an upgrade. This does not seem to refer to your contract start date, but the phones age?

Surely I should be ellegible for an upgrade?
 
And this is why they should not allow early upgrades.

Basically, when you upgrade for the FIRST time...you extend your contract by 24 months. If you do it after month 22 - you will find, there are 26 months left till your next upgrade. They don't "end" your previous contract early just because you upgrade early, that contract still has to finish it's 24 month term. In essence, everytime you sign on the dotted line you commit to a full 24 months.

I believe it's right of them to make you wait to get a new phone, but they should have informed you of this when giving you the early upgrade last time.
 
Thanks broken1, I figured that is the only way to make sense of it. I "material" i read from Vodacom refers to your eligibility to upgrade when your "phone" is older than 24 months (not contract).

All smoke and mirrors I guess - will have to wait it out!
