Warning Letter From ISP

I already own said title on blu ray but I don't want to infringe on copyright laws by ripping the title, getting an online copy of something I own already isn't illegal? I just don't want the hassle to keep swapping discs and use a HTPC. If the movie or any movie for that fact was available locally as a paid-for download - I'd be first in line.

Nope. It is up to them (And you as the customer).
Same way that it is illegal for the US government to log your activities on Google etc without court orders (It violates privacy laws) but Google itself violates your privacy by monitoring your activity, which is legal, as they are a private company and you have a choice to use them or not
 
Don't stress about it. Overseas companies monitor the IP Addresses and forward copyright notices onto the providers. Some providers like telkom just discard the notices, others pass them along to cover their own asses. They just want to know that you have deleted the material and then they're in the clear.

So what you saying is that the private company owns the movie?

Two different issues, but yes.
Paramount (A private company) owns the movie.
Imaginet may inspect and monitor all traffic that goes through their servers (Which I doubt they do. But they can)

EDIT: They might actually do it for throttling, but I imagine it is not a deep inspection

FYI, anyone on IS backbone will have to FWD these to you. It's not Imaginet themselves, it's IS. Imaginet has to comply with IS rules
 
I would not worry about it. Some ISP's do forward these messages and others don't. Water's are too murky between ISP's and movie companies. They don't have right to impose their issues on the ISP - The ISP cannot control what the user is getting, they can frown about it, but they too, have no ownership on content. When they do forward that notice, it is pretty much a courtesy to whatever company or to maybe discourage you from using more bandwidth with a "Passop Papa". :). I may be wrong here but this is how I have heard it over the past couples years - And it seems to make sense.

The short answer - ignore it.

I'll play it by ear, I don't download much. But I'm not going to worry about it for now. Once I get a court order I'll start packing and head to Canada!!!

You don't own the movie. You licensed the right to view it on a specific medium.
You can get most movies on iTunes or similar services

Imagenet is merely bound by their MOU with IS to inform you about it. In our country there are no explicit laws around this issue :)

I don't think they are allowed to do anything unless they get a lawyer in SA to represent them? It doesn't make sense cause our piracy laws are diffirent from those in the US. For very obvious reasons you can expect us to know the laws in other countries we dont reside in. Not saying we can break their laws but still If I'm in South Africa and they quote "Copyright Act,
Title 17 U.S Code Section 106(3)-(4)" that means bothing really cause the infringment happend in a non us country.....

Maybe I'm wrong but if they want to do anything they need to send you a letter that quotes south african pricay act?
