Watch out before using your phone while driving

What If I make a call while driving, but use bluetooth and I also happen to be in an accident? Or i make a call without using bluetooth but claim I was using it after the fact. Or claim I had my headset connected? How are they going to prove otherwise?
 

The problem comes in not that you are holding the phone, it is that you are trying to concentrate one two tasks simultaneously.
Most people are too bloody retarded to just drive! Now they must focus on receiving information via the phone, processing it and formulating a reply, all the while constantly receiving information from the environment around them while driving, processing that and responding accordingly while driving.

Simple solution to a simple problem. You should not be allowed to use a phone/hands free in a car, period.

Discovery Insure app tracks phone motion.. if your phone moves significantly it's identified as driving use. I've always had my phone in a clip on dash or in pants pocket with zero movement detection.

So car radio's should be banned next? Radio has been in the car for how many decades now.. how much accidents are as a result of people listening to radio?


Most people who drive all over the show on the road i've seen are either noticeably drunk or handling phone while driving. I've yet to see someone drive badly while chatting on phone with a handsfree kit.

It would be hard for a case to be made that the movement on my phone was as a result of phone usage rather than movement that is expected in when one is involved in a car.
 
Your service provider would also have logs. So your phone is actually just needed to link it to the scene/location. (I watch too much CSI)

The sooner all calls (even hands free) and texting while driving becomes socially unacceptable, the better.

Exactly, and given the widely reported excessive sensitivity of Discovery's driver monitoring software which detects perfectly reasonable and safe driving as dangerous it's not a good idea to trust their phone use detection.
 
So if you are using a hands free kit and location tracking and navigation software to prompt you this would be a problem? Seems a bit thin.

It is a pity so many people can't seem to get the prioritize the action of driving over the call, really the person on the call can wait a second or two while you focus on driving.

Ofcourse they don't need the phone, thats just them punishing you.
 
What if you have a car kit and was connected via handsfree?

I've driven with a hands free kit and I was noticeably distracted while driving.
I was no longer scanning the verge of the roads for small kids and animals who may cross in front of me, I wasn't able to keep a mental image of the cars closing in on me from behind or taxis which were in my blind spots just waiting for a chance to jump in front of me and cut m
Yes, I could still drive and indicate while turning and changing lanes but I was definitely less aware of my surroundings.
There's enough research to prove this point.

I also don't talk to passengers much while I'm driving and my wife doesn't mind because she knows that I need to concentrate when I drive.
Playing music on the radio is not something I pay attention to so I don't see that as a distraction - it's just background noise.

Would you be happy if the pilot on your next flight was chatting with his girlfriend on a cellphone while trying to land the aeroplane?
In aviation it is frowned upon even for ATC to speak to the pilot while he's in the final stages of landing unless it's an emergency. That's because pilots don't need distractions in certain critical phases of flight.

Why should it be any different for vehicles which zip past each other in opposite directions, separated by only a couple of meters with closure rates in excess of 200km/h?

The suspect device is forensically duplicated.
One major concern I have is giving some third party that sort of access to my data… in short it ain't gonna happen.

As far as the law is concerned using a handsfree kit is legal anyway.
