Wait a sec: is this current developer the 'owner' of my website? I've paid in full for an incomplete product that needs fixing, but I was hoping to own the website in its entirety...

You can't license code you didn't write. Even then, you need to discuss source rights up front. At least if you're using an interpreted language you can get a copy of the source and someone else can pick it up if the dev hits the fan.
