Telkom kan maar enige lastereis teen die webmeesters van Hellkom en telkomsucks.co.za op sy maag skryf en met sy hemp afvee.

In die lig van verskeie nuwe beslissings, sal die howe waarskynlik die opmerkings en die webwerwe as "billike kommentaar en vryheid van spraak" beskou, meen me. Luandri Partington, direkteur van IT- en handelsmerke van die Sandtonse prokureursfirma Hofmeyr.

"Dit is immers 'n verskanste reg in die Grondwet."

Die verbruiker het 'n stem en gaan nie langer swak diens aanvaar nie. Dít moet groot maatskappye maar begin besef, sê Partington.

Partington se kommentaar is in reaksie op die storm wat losgebars het oor twee webwerwe waarop ontevrede lede van die publiek hul griewe oor Telkom se dienslewering (of gebrek daaraan) kon lug.

Telkom is woedend en dreig die webwerwe met 'n skadevergoedingseis van R5 miljoen.

Maar 'n onlangse beslissing van die appèlhof in die geding tussen die
Delta-motormaatskappy en mnr. Jaco van der Merwe oor die woorde Swakste 4 x 4 x ver, wys Telkom se saak is bra ****elrig.

Delta het in sowel die hooggereghof as die appèlhof op grond van die beginsel van vryheid van spraak die onderspit gedelf en sit nou met 'n yslike regsrekening opgesaal.

Op 'n meer regstegniese aspek sê Partington die relletjie tussen die webwerwe en Telkom draai eintlik om die Wet op Handelsmerke.

"Die sleutelwoorde in dié wet, wat die misbruik van handelsmerke verbied, is "gebruik in die loop van handeldryf".

Die argument is dat die webwerf nie die woord Telkom in sy webadres in die loop van handeldryf gebruik nie en dat daar dus geen aantasting van Telkom se handelsnaam is nie. "Die gebruik van die woord Telkom in die webadres kan dus nie as misbruik beskou word nie."

Die skeppers van die Hellkom- en telkomsucks-webwerwe blyk hul huiswerk op alle gebiede deeglik te gedoen het.

Mnr. Hans Muhlberg, 'n handelsnaam-prokureur, sê by nadere ondersoek bevat die webwerwe ook geen inhoud wat as haatspraak beskryf kan word nie en die webwerwe is nie vir kommersiële gewin geskep nie.

Dit verskil wesenlik van die saak tussen Laugh-It-Off (LIO), die vervaardiger van T-hemde met satiriese boodskappe, en Suid-Afrikaanse Brouerye (SAB).

Die T-hemp-vervaardiger het SAB se Black Label-logogram en leuse verander van Black Label - Carling Beer. America's lusty lively lager since 1852 na "Black Labour - white guilt. Africa's lively lusty exploitation since 1652.

LIO se appèl word later vandeesmaand aangehoor, maar Muhlberg sê SAB het volgens die wet alle reg gehad om LIO hof toe te sleep oor dié handelsnaam-skending.

"LIO het die saak verloor as gevolg van twee faktore," sê Muhlberg. "Hy het 'n afbeelding van die Black Label-advertensie gebruik om sy T-hemde kommersieël te verkoop, en omdat die regter gemeen het die bewoording van die satire raak aan haatspraak."

Sentech het ook onder só 'n webwerf deurgeloop. Dié IT-maatskappy se prokureursbrief wat aan die eienaar van www.****sentech.co.za gestuur is, is in die Augustus-uitgawe van Noseweek gepubliseer.

"Die brief beweer mnr. Shaun Dewberry, eienaar van dié webblad, probeer die indruk skep dat daar 'n verwantskap tussen die oorspronklike handelsnaam en dié een is, of verwarring daaroor by verbruikers skep," sê Muhlberg. "Enigeen met 'n halwe brein kan tog sien dat dit nie die geval is nie."

well well this is intresting now we have got a opinion from a respected and well known law firm ... i would love to see what telkom has to say next ...
 
Just a thought on the upcoming legal action.

Telkom in the past has always used the slow legal process to extend its monopoly and squash or intimidate anyone opposing its position.
In retrospect Hellkom will be able to do the same.
In this protracted time period, Telkom will bring more attention to its already shaky position. As Telkom in itself is its own worst enemy. No amount of money or fancy lawyers is going to protect Telkom from The Publicity it will draw to itself.

SA will see the truth behind all the legal mumbo jumbo.

I'm just waiting for the day Telkom drags Hellkom to court as it's the day this person becomes an activist. I'm busy thinking of different logos I am going to paste on billboards in front of the courts. I personally will be next to Gregg of Hellkom with my own Hellkom placard. If anyone here is ready like I am, then speak now as I like Mad am the hell in. Telkom has gone too far. Instead of addressing the issues of Telecommunications in SA, they want to go to court. That will be at their own peril believe me.

BTTB, I totally agree with you. This is going to draw so much negative publicity for Telkom, it's absolutely wonderful for our cause. They're playing into our hands, thanks Telkom.

This action against Mad must be quite hectic for him, but it has inspired me into a new pro-active mode.

We might not be able to beat the devil (Telkom), but we can make lots of dents. And no matter what the outcome, they are going to be the ones with egg on their faces.

Listen guys, I met Mad or Gregg of Hellkom on Saturday. This chap has got balls believe me. I will support him all the way. In actual fact I admire him as he is setting an example amongst his peers, some of which might criticise Telkom, but fail to actually do anything about it. At least he is doing something and he feels very strongly about the matter. This guy has resolve and we should support him 100%.
Perhaps his methods might be irregular, but normal channels are achieving very little. Lets be honest with all due respect to MyADSL, has Telkom actually, really sat up and listened to what we have to say? They could be just beating about the bush, wasting our time and effort, which is probably the truth. Has ICASA done anything meaningful yet? Hearings and meetings and it's all just talk. Don't get me wrong, I do not wish to polarise the situation with Telkom, but perhaps they forgot we existed. Just a reminder call thet we are still here and our patience is wearing thin.

http://www.hellkom.co.za/ has shaken the rock under Telkom. Let’s hope that the little wake up call has some results now.

I'm beginning to think that publicity is the only way of achieving anything in SA.
Look how long it took the government to roll out Anti Retrovirals.

Shareprices! that's where we need to hit them. How much do you think it will hurt Telkom if this negative publicity drives their shareprices down?
