When is New not New ?

There is a dealer in Stellenbosch that sells old stock ( 5 years old ) as new.
According to them the stock has not been used and was on the shelf for 5 years, so it is never been sold.

I was unfortunate to buy one of these "new" items.
Off-course it did not work.

Now - when I try to return this item for a refund ( it does not work) - I have to wait until /if the manager decides to give me a refund ( its been two days now ).

Anybody know what is the law on selling out-dated items ?
 
What items are you talking about?

There is no laws regarding selling of NOS (new old stock). Of course the ethical thing is to advertise it as such.

The onus is in you to know what you are buying, and weigh the risks accordingly.
 
Battery leak perhaps? Take it back and demand a working replacement or your money back.

If they don't want to refund on a product they knew was old, it sounds very sketchy then. They should't even be selling old products like that if it's been on a shelf so long.
