Why does my latency fail after 8pm

Without fail, sometime soon after 8pm, every night.

My latency goes up to 400 and above. All day it is at 210. Why now? Why I ask?

try a free account (most ISP's have a test account) at 8pm and see if the same happens.

This happened to me on uncapped (shapped) accounts until i upgraded to a capped account.

Its worth a try but there's still a good chance its the exchange.
