Winding up estate

Hey All....

I need your advice. To cut a long story short my mom passed on about two years ago. There is no will and I would like to sort out her estate. Where do I start? The only thing I currently have is death certificate.

Joh thats a big problem.

First find out who is the exucutor of the estate. Most of they time it would be a bank or relative. If no executors were nominated then you have a HUGE problem. They call it INTERSTATE. That is where the government handles the estate etc. I have no idea who to go to if it is interstate.

Since your mom died intestate (no will), it would be best to find a good lawyer to assist you. They normally take a standard fee which is based on a % of the value of the estate and they will deal with the Master of the Court which is a prerequisite in the case of an intestate death. A lawyer can also deal with the estate duties payable where applicable.

There are a few forms that you need to complete. Best is to contact an attorney to assist you and tell you the procedure and costs.

Best advice is go to an attorney as others have stated, the fees is approx 3% of the entire state.

Good Luck, its a lengthy process
