ANC has released their list.

1 - AIDS Sower boy
2 - Kgalema Motlanthe
3 - Baleka Mbete
4 - Trevor Manuel
5 - Winnie Madikizela-Mandela.

They do not mind having a convicted fraudster in their top 5 as long as it is legal:

Madikizela-Mandela has a fraud conviction hanging over her, though this did not present a problem to the party as its consultation with lawyers found that there was "no legal reason to exclude her

We knew that there would be a lot of interest [in Madikizela-Mandela]. We did look into her case ... we consulted lawyers on the basis of that ... and the lawyers found no legal reason to exclude her

Oh, my Gawd. They must be desperate. Just Imagine her ruling? Would she instruct/entice all to use the necklace against COPE?

And........ Former health Minister Manto Tshabalala-Msimang was number 25 while the wife of convicted fraudster Tony Yengeni, Lumka Yengeni, was at number 38.

Manto was a big embarrassment but still she is highly regarded by the mob.

I once spoke to a former police officer involved in the investigation of Winnie. According to them, she's as guilty as sin and was very fortunate not to be locked up for a long time. The ANC heirarchy must know her story, so what are they playing at??

And the courts agreed. The technicality is that she was given a suspended sentance and hence is eligible (sp?) to serve in Parliament.

AFAIK the only difference with a suspended sentence is that you are not incarcerated. In the eyes of the law you are a criminal for the duration of the suspended sentence.

I reckon some serious strings were pulled to keep Winnie out of jail :mad:

what was it ... like 43 counts of fraud she was convicted on ? Her partner in crime is sitting behind bars right now.... and let's not even go down the Stompie path :(

According to a UNISA professor she is not eligible for parliament

"During the existence of that suspension you are somebody who is considered to be a criminal. You are free, but not from a criminal point of view, you are simply not incarcerated," he said.

"She is not eligible to become a member of Parliament until that period has expired. My understanding is that that interpretation of the Constitution is in line with the letter and the spirit of the law."

Yes, but the ANC is saying the suspended sentance period has expired. As your link points out, you are not eligible during that period, the constitution says nothing about thereafter, hence the legal advice saying there is no legal reason to exclude her.

the Constitution bars a person sentenced to more than 12 months in jail without the option of a fine from Parliament, and from the provincial legislatures until five years after the sentence had been "completed".

Aunty Winnie was convicted and sentenced to a 3 ½ year sentence suspended for 5 years.
If I understand it correctly this would mean she would only become eligible some time in 2013
