Completely off topic question here, but hopefully someone knows a bit more than i do.

I purchased a small holding a few years ago. I asked if the existing worker could stay on, and he was happy to do so.

The worker is deaf and mute, so communication is very difficult, but he is a clever guy and can read some lips.

I have subsequintly figured out that he is from Malawi and i tried to get a pension and UIF going for him, but could not get any passprt or visa info from him.

I managed to determine that he had a passport and birth certificate and he gave it to the previous owners' wife, but she lost it, i spoke to her and she confirmed it.

He also came to SA with his uncle, whom also worked on the small holding but unfortunately passed prior to us buying it.

The problem i have now is, i do not have a passport or id number, no contacts for malawian relatives and i REALLY want to get him a bank account, UIF and a pension.

How would i go about sorting this out? i am a little bit scared to go to home affairs as i do not know what they will do with him, nor does he have family in malawi that can help out if he is deported.

Any help would be greatly appreciated.

Anyway, he has to go to the Malawi embassy or consulate and get his passport and birth certificate reissued. If he already had one then it shouldn't be difficult. If he doesn't even have a copy of the passport or the passport it might be a little tricky.
Deporting cannot happen unless he has a passport. But you don't know what tricks HA will come up with once they know someone is illegal.
But I have seen tons of illegals staying here with no issues. The worse that I have seen is them being issued with a letter declaring them unwanted and asking them to leave.

The poor fellow is just one of millions of illegal immigrants due to the stellar behavior of their own countries behavior.

According to many on this forum rather send him home, as any country north of the Limpopo is a land of honey, milk and incredible wealth. Gold lines the streets, diamonds pour out of taps. Caviar is consumed by the ton.
Hell I'll even go and look at live there.

Actually all the dude can do is go to his embassy and try to get his original documents. Thats if he had any to start with.
If he can't remember his original id number or passport number he is pretty much fkd.
Or go back to where he came from and get the documents he needs.

Quite simply there's nothing you can do. Even if the guy had a passport, he's obviously in South Africa illegally, and there is no legal way for unskilled foreign workers to get a work permit. And without legal status you cannot open a bank account in South Africa. I'm not saying that I agree with the way the system works, but that's the sad reality for illegal immigrants in South Africa.
 
How so? Is it because Malawi does not border on SA?
Its something to do with the fact that u have to prove to the other country that it's one of their citizen. There is a whole process and paperwork that needs to be done before the actual deportation.
It's a common tactic many illegals around the world in other countries do this, burn the passport once they have entered the country so that they can't be deported.

I think my first step is to get in touch with the malawian embasy here in SA.
