Hi

Quick backstory: A few years ago I was arrested on the grounds of a minor drug offense. I did not sign the guilt admission form and spent the night in jail, and the next day the inspector let me know I will not need to appear in court since my case has been thrown out, due to the complete non-issue that it was. Accordingly, I do not have a criminal record.

Fast forward to now, I want to apply for a Visa to go to the States. However, in the "security" section the application form specifically asks "Have you ever been arrested even if pardoned at a later stage", and not whether I have a criminal record.

This worries me, since the guide that helps one with filling out that section pretty much states that answering yes to any of those questions will result in a denial of application.

I am not sure how to go about this. Surely this can't prevent me from ever going to USA? I am contemplating answering "no" to that question and hoping for the best.

If anyone has any relevant knowledge or experience it would be greatly appreciated. Thanks!

You were never pardoned because you were never convicted. But you were arrested... do the SAPS keep track of arrests? And for how long?

I would just say no and carry on with my day.

Don't overthink it.

I think when they mean arrested they mean to say "arrested and appeared in court" not just arrested.

SAPS has a record of you being arrested. Dont answer no before phoning the embassy. If they find out that you are lying, which they will, you will never be able to visit the US on a personal passport.
