You'll need to be stupid to lose an account like that. In controlled circumstances, the ownership of an account can easily be transfered to someone else.

The problem is the change of email and the secret question/answer.
The account that was stolen was played after it's purchase for quite some time which is why the loss was such a suprise.
Still I suppose more pressure could have been put on the buyer to change the details.

I would only Buy/Sell an account is it goes as following.
I meet the buyer either at his place or mine. I have the cash and show him.
He gives me the password and username. I change the details and all before giving him the money. Once that has been done, he's free to take my money and leave

Let original owner change e-mail, it require authentication to old e-mail address. Once that is done get the PW and account name. Log into the account and change the pasword. The original owner can still get the account back by e-mailing blizzard with his account details.
You can change everything but you cannot change the account name, and name associated with it.
Buying gold or getting a char leveled that is another thing though... Buy a second account use your same name you used for your original account. Get the char leveled to 70 then transfer it to your account, (need to have the same name of account holder).
Use the extra account for buying gold and just buy ah stuff and send the items to your original account, gold is tracked items not...
