i downloaded the back compatability update online on my pc so figured it would be the same with the system update

as soon as it is out, it will also be available from xbox.com for download,

No the updates don't work like that, there are only 2 ways to get it:

1. Online - hook up your 360, via ICS on a PC is easy enough, you can use it to bridge a dial up connection quite easily. The update is only 7Mb, so will take an hour or so on dial up.
2. On a new game disc - games coming out next year will ship with the update on the disc.

Yes, a silver subscription is mahala, gratis, etc, etc, only gold (i.e. playing games on-line) is gonna cost you. Plus many Xboxes come with 1 month free gold membership!

Just register for the silver live account ad u'll get it...Got the update an hour ago. So far so good. xvid files are working great.
