Zille said yesterday that she will head the party's new national list for the National Assembly.
Additionally, if the DA retains the Western Cape , Zille will remain premier.
Federal executive chairman James Selfe said Zille's national list nomination did not preclude her from also heading the list for Western Cape premier.
"[It is] by virtue of the fact that she is entitled in terms of our regulations to be number one on any or all lists that the DA has."
Selfe said nominees could occupy a position on both lists, but if elected to one of them, their names would be "erased" from the other list.
Selfe said "broadly speaking" there were a "handful" of people who could serve on both. These were mostly premiership candidates, he said.
The decision by the party for Zille to top the list follows Agang SA leader Mamphela Ramphele's U-turn on the DA's offer that she stand as its presidential candidate.
Zille denied that the DA had suffered from the debacle.
"If anything we will gain 1% or 2%, because Agang is virtually out of the water now," she said.
The leader of the ANC caucus in the Cape Town city council, Tony Ehrenreich, said Western Cape mayor Patricia de Lille should be held criminally liable for any injury or deaths caused by the city's neglect of beaches catering mostly to the poor.
Ehrenreich said he has filed a complaint with the office of the public protector to look into Cape Town's spending patterns.
He claims "hundreds of millions of rand" are spent on facilities at "white areas" like Sea Point, while areas like Monwabisi are neglected.
He said the water break that the city built at Monwabisi creates rip currents and endangers lives.
Acting Cape Town mayor Ian Neilson said the city spent R6-million on upgrading Monwabisi Resort, including new chalets.
