BlackBerry outage lawsuits

Research In Motion is being sued in the United States and on its home turf in Canada for a BlackBerry service outage that affected millions of people worldwide.
 
That is pathetic - $ 1.75 loss for the consumer, and all the fuss ? I am not a BB user and never have been, but that is pathetic.

RIM customers are cutting their own throats. The company is at an all time low, shares have plunged to 1/6 th of their value 3 years ago. They are in a desperate situation - they need to build more facilities, they only have one in London and one in Canada.....but they don't have the capital to do it. If this happened 3 years ago, they would have been able to throw money at the problem and increase their capacity. But right now, it will take a miracle for them to bounce back
 
completely agree with @surfs-up. BB users are shooting themselves in the foot. If BB recover from this I will be very suprised. I can see another manufacture possibly buying out BB and converting it to Android ;)

This is absolutely ridiculous. The only people who are going to benefit from this are the lawyers.
I'm not a BB fan, but come on, what good is going to come of this? If it was my SP I would rather they spent the $1 in investigating the cause, and putting systems in place to prevent this happening again.
 
Yea, retarded move, BB users basically killing their own devices.
 
So...let me see, the users are at fault for taking action against a corporation that offers and charges for a service and fails to deliver?

Can we accept then that Slyfly, boswald, sufs-up & co. won't say a word when their current mobile service provider and/or internet service provider fails to deliver their agreed and paid for services?

Seriously, lamest argument ever.

Every company providing similar services, ISPs etc. experience down time some or other time. Happens all around the world, all the time.

Best you get over it. Do people sue their ISP each time they go offline?

Courts should not have to waste their time with **** like this.

This law suit does not represent all bb users. Who in the right mind would sue for such a small amount, the only one who will benefit from this is as someone said, the lawyers! This is about greed, pure and simple.

We can extend this to any service, agreed on and paid for.
 
Only people who're going get rich are the lawyers. Read the BB/RIM terms and conditions (Section 19b). It seem to me we've been pretty lucky with the 'free software' offer, for what it's worth:

(b) Service(s).
(i) EXCEPT TO THE EXTENT SPECIFICALLY PROHIBITED BY APPLICABLE LAW, EACH SERVICE IS PROVIDED OR MADE ACCESSIBLE "AS IS" AND "AS AVAILABLE", WITHOUT CONDITION, ENDORSEMENT, GUARANTEE, REPRESENTATION OR WARRANTY OF ANY KIND BY RIM.

(ii) RIM DOES NOT WARRANT OR PROVIDE AN OTHER SIMILAR ASSURANCE WHATSOEVER THAT UNINTERRUPTED USE OR OPERATION OF ANY SERVICE, CONTINUED AVAILABILITY OF ANY SERVICE, OR THAT ANY MESSAGES, CONTENT OR INFORMATION SENT BY OR TO YOU WILL BE ACCURATE, TRANSMITTED IN UNCORRUPTED FORM OR WITHIN A REASONABLE PERIOD OF TIME.
 
Those suing RIM are within their rights if they can prove that:

1. The service was lost due to negligence on RIM’s part.
2. Lives were lost due to lack of access.
3. There was no other means of communication available to them.
4. Their blackberry did not work again after the service was restored.

Otherwise, get a life!

So if telkom goes down or seacom breaks for a week we should all phone our lawyers?
