I refer to my thread a few months ago. Thanks to all who assisted me and sorry to the naysayers
Here are the results:
Been there, done that and got the T-shirt. Proudly a consumer today after successfully taking Vodacom to the small claims court and having them back down.
I booked a iPhone 5 into Vodacom repair centre in Sandton City for a battery recall program from Apple with no faults or queries besides to replace a manufacturers faulty battery. The phone worked but the battery with be flat by late afternoon. A week later I received the phone back from Vodacom to find the screen was now cracked and the phone no longer turned on.
I immediately booked the phone in again with Vodacom, confirming with them that this was not the state of the phone when booked in and escalated the query immediately informing them that this was unacceptable.
With numerous queries and followups I received my phone back with the screen repaired but the phone no longer turning on. Vodacom refused to repair the phone battery and had claimed it was booked in not working.
I tried through every angle I could think of to resolve this and contact every person with whom they would let me speak to, to resolve the issue with no assistance. I retrieved my phone from them informing them I would take legal action against them but as a corporate they gave me the cold shoulder. I then took to social media but that proved no success and their response on “Hello Peter” was simply - “Your query has been addressed”
Next step, small claims court, Randburg, got the forms and simply filled them. Walked my way into Sandton Vodacom and had staff members scampering around the building all to scared to sign a letter of demand at which point I left with a unsigned letter. (Its purely just a confirmation of delivery signature, not a plea Vodacom…)
At that point I waited my 14 days with no response and then took a drive to the sheriffs office in Midrand and they happily assisted it delivering the court date to Vodacom for a fee of R150.
Having all my documentation ready and awaiting my court date, I received a call from the Vodacom manager in Sandton asking for me to come to their offices and bring my phone with me for them to investigate the issue further. I debated this with myself as I felt it was wrong of Vodacom to contact me at the 11th hour but agreed to book the phone in once again as per their request.
Needless to say within 5 days, my phone was replaced and my case is closed, without having to make the trip to small claims court.
If your case is strong enough and defies logic as to why a corporate like this will not assist a nearly 20 year customer - take them to court! If you don’t win, you will learn at the least. Don’t listen to the naysayers. No lawyers allowed in small claims which means its equal ground.
If anyone needs assistance, feel free to contact me further on [email protected].
Sincerely
