I did contact them immediately and they said they would collect it. That was 2-3 months ago. I'm moving shortly and don't have the space for it.

I'm pretty sure there is a prescription period which applies. Rather contact them again in writing (and ensure you have proof of receipt) and state that it will be sold to defray costs of storage unless it is collected within a specified reasonable period of time or simply return it yourself. Selling it may get you in a world of trouble. Also, since you opened it you might fall prey to their terms and conditions should someone have signed for it etc. My 2c but best to get some formal legal advice.

according to http://www.saconsumercomplaints.co.za/your-rights/

e) RIGHT TO RETAIN UNSOLICITED GOODS WITHOUT PAYMENT

* Consumers may return unsolicited goods or services at the expense and risk of the suppliers.
* Unsolicited services and goods may be retained after twenty Business days.

As I did not order the 2nd item, it falls under Unsolicited Goods. I did inform them of their mistake and gave them a chance to collect the item, that was exactly 2 months ago (checked the order). In my opinion they have had ample time to come collect it.

Your interpretation is flawed. Hopefully it doesn't come back to bite you. Good luck.
