Taking Busisiwe Mkhwebane's argument to the nth degree, the solution seems obvious to me: if the person fulfilling the role of president is the only one who can appoint a judge to a commission of enquiry to investigate the current president, [highlight]the current president must resign so that the successor (president) can appoint the judge and commission of enquiry[/highlight].
 
Right well I guess that's the end of the public protector being the hero in this story...

Intelligent me says the public protector must find that the president must ask the chief justice who to appoint and then appoint that recommendation, since he is the only one with the power to do that...
 
There is a reason that they need at least six hands: this state capture business is hard work with all the rear-ended arms all the way up several well placed key puppets (PP). And sometimes they are forced to delegate the puppeteering to other family members, especially when the YL goes full retard with the misguided notion that it can think for itself.
 
Shouldn't the PP be an expert in law? Why would one expert in law ask another what is lawful or not?
