I disagree: even if the Competiton Tribunal were allowed to 'bargain' with monopolistic entities such as Telkodemonopolies, such bargaining would only serve to reinforce Telkodemonopolies' opinion that it is above the law and can do whatever it wants and get away with it without being held accountable.The Competition Tribunal should Bargain with Telkom in that it should get them to bring the Broadband rates and connection fees down, in line with government thinking, before the deal goes ahead.

Considering that Telkodemonopolies still has a fixed line monopoly in SA, IMO the Competition Tribunal should rule that Telkodemonopolies' monopolistic position must first change with the introduction of substantive fixed line competitors, before reconsidering the BCX merger at any time in the future, for now the BCX merger cannot be allowed to go ahead.
