Delportshoop man shot dead while stealing oranges

All the clutchies on FB are praising the shooter and celebrating, sick ****s I swear... and they're old tannies and ooms.

Anyway, this old man is 100% going to prison. There is no way you're going to spin a story about xyz... sorry to say the law is very clear when it comes to someone entering your property. You can only shoot them or if you live in Bo Kaap detonate your explosive vest only when your life is being threatened. A man picking an orange from your tree in your garden is not threatening your life.

The law is pretty clear, unless your life is in danger, the minute you draw your firearm you are in fvck around and find out territory.

This guy fvcked around big time and he is going to find out.

Only if the story is true. There have been many examples of families claiming that the burglar was only there to whisper sweet nothing's to the trees and fairies when the truth comes out in the court case things are much different.

the higher courts often do not take as binary an approach - instead relying on "the reasonable man" approach.

assume you are on your property and an intruder approaches.
1) you fire a "warning shot" into the air or ground, in order to make it very clear to the intruder you are armed.
the intruder ignores you, and continue toward you and then you shoot him in the chest.
or
2) you fire a shot directly into the chest of the intruder on sight.

which scenario do you think the court would be more lenient towards ?

I read somewhere that an argument against a warning shot is that if you have time for a warning shot, then you may have time to get away.
 
Do warning shots work? A policeman once told me he's working in a gang infested area and firing a warning shot would get him killed.

He told me if someone waves a firearm in front of you, you try to disable them, if it happens to kill them in the process, well, that's collateral damage.

Fire a second round into the ground.

This isn't The Good, the Bad and the Ugly.
 
My previous post wasn't aimed at this story per se.

It appears these were regulars and there was some attempt at a warning sign, but it looks more like a zebra than a dog; probably confused the deceased.

If these indeed were regulars, the oom could have put in more effort to effect a citizen's arrest, but at his age probably has a bad back and using Vicodin or Viagra so wasn't thinking clearly.
