Get reported to the Crown prosecution service for not having a licence to be stolen from, and not having an orange growing licence.

Don't think that will fly. He ws inside his (presumably locked) house and fired out the window into the garden.

No ways he will get off. That ain't self defence. It's not Murica - you can't just shoot someone and get away with it. Your life has to be in danger in order to shoot someone. (ie that are about to stab/shoot/kill you)

You mean Texas, which is about the only place in the world where you can use lethal force to defend property. Other states follow the same rules as you mentioned. Which is you have to have a reasonable fear of your life being in danger.


When is Lethal Force Justified for Property?
Under Texas Penal Code Section 9.42, you are justified in using deadly force to protect land or tangible, movable property if all of the following conditions are met: [1, 2]
  1. Lawful Possession: You must have a legal right to possess the land or property. [1]
  2. Immediate Necessity: You reasonably believe the deadly force is immediately necessary to either:
    • Stop the imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime.
    • Stop someone fleeing with your property immediately after committing burglary, robbery, aggravated robbery, or nighttime theft. [1]
  3. No Other Option: You reasonably believe that either the property cannot be protected/recovered by any other means, or that using non-deadly force would expose you or others to a substantial risk of death or serious bodily injury

This is just a symptom of a larger problem everyone is all too well aware of.
Desperation on both ends. People having to deal with crime and a useless police force and the other end of folks without jobs and a means to feed themselves.
It’s easy to say just get a job, or secure your property but neither of these things are what people should be dealing with in a normal functioning society.

Getting or having to kill someone for some oranges is crazy. Even if they were trying to get into your home killing someone is going to haunt you.

Nice little tinderbox created by… a really bad government and worse still their knobhead supporters. If they weren’t so incompetent you’d think it was by design.

Yeah my FIL was beaten up with a brick in his own yard. They guy was trying to kill him with a knife but FIL hang onto the guys' hand while he was being beaten up with a brick. So at which point do one start defending oneself. The guy was just there to steal some chickens.

Stealing some oranges se gat. If there was a farmer nearby they won't hesitate to kill for some oranges.

Would have been entirely justifiable to shoot them if they were approaching your FIL with a brick, as a brick is a lethal weapon.
