Hi all

My finace had an accident with an uninsured driver last week and now the person is harrasing us, I'm busy sorting out the details with the insurance and all is well on our side (excess waiver FTW!) but now the question that is bothering me, can I tell this person to piss off as they have no legal re-course?

Yep tell them to piss off. It's not your fault that they don't have insurance, and your insurer will likely contact them for reimbursement. Let your insurer deal with them.

Another advantage to insurance - they can fight with useless bums.

Ja, give it all to the insurance company and let them sic Bubba on the guy! He will soon be squealing! :D

Do not speak to him.
Doesn't matter what he says, he'll try to get you upset.

Let your insurance company handle it.
You can phone your broker and tell them he is hasseling you

+100 he has no legal recourse at all...all you tell him is that if he wants to bug someone, do so with the insurance company and not you.

Dude its not your fiances fault so what could he be posibly bugging you for?

Give him the number of your insurance and tell him to tlak to them they will be sending him a bill so his problem not yours

Exactly, if he's the one at fault, he has no reason to bother you at all...it should be the reverse, but thats why we have insurance.

I also vote for telling your insurance company he's harassing you.

from what i can gather they went through a red robot and clipped her while she was turning across the lane, so not her fault.

rofl and they wan't her to pay.

@hoegh
same thing happened to a friend of mine. She's still trying to sort it out.
Please let me know whats been happening with your case, and what the insurance says (who are you insured with btw?)

Not necessarily true. There are many aspects to such an incident which could actually put the fault on either your fiancé's actions (or lack of action), or split the blame 50 / 50. There are many rules that govern a situation like this, one of which is "You may not enter an intersection unless it is safe to do so", and another one they like throwing around is "The driver has to keep a proper lookout". Combine those two and you quickly find yourself in a situation where the other guy "broke the law", but you end up being guilty, should you have failed to observe the above "rules".

Best is for the insurance company and their legal department to handle it, depending on the circumstances, a clever lawyer could easily have a judge find in favour of the other guy.
