As per title
The said they'd refund me for July... Hell they offered...

So, the date came, and went...

So I decided to follow-up today. And as it turns out, they have "NO FREAKING IDEA" (TM) of what I am talking about.

Now the thing is, I had to provide to them the actual time and date of the call they made to my cellphone, before any action further was taken today.

So, out of principle, I would just move on, but then, don't offer me a refund and then not pay it

Was this discussed via a ticket with our team?

Yes today
Your people put it on record to the ISPA that you spoke to me.
The phone call, which is now coming into question is this one - as taken from my iPhone's call log:

30 July 2015 (011) 612-7200 12:51PM Call duration: 6 minutes.

I again, respectfully request that you check your recordings, that is, if you do actually record your calls.

Alternatively, please contact my attorneys, because I do not take kindly to it being implied that I am being dishonest!

If the query is with ISPA it'll be with another department, and that process needs to close itself off.
If a refund was promised, we'll stick to that and process the refund for you - I can chase this up via a ticket ref# - however if this has been included in an ISPA query we will have to follow that process.

EDIT: I've tracked down a ticket with our team, I believe the ISPA process is still ongoing, so any other team won't and can't get involved in an ongoing legal issue. Part of the query is a refund, which will be processed by our Legal teams going forward.

Issuing a refund is not necessarily a dependency on the outcome of an ISPA COC. In my case, Afrihost refunded two months of business ADSL due to poor service delivery.

The ISPA COC is still ongoing and now with the adjudicator for investigation.

I think more people should request compensation for services not delivered or having to pay to test your network (typically people participating in a POC get services for free or compensated).

Most honourable ISP's would settle long before it gets to adjudication. In fact it's quite hard to get ISPA to go that way if the ISP is refunding etc..

It isn't really about that, when an ISPA complaint is lodged, there are specific procedures that we follow along with having a specific Team handling the query itself. Opening a parallel query isn't really going to speed up the process as it is handled by two different departments.

So what is it going to be AH?
Do you know my new ISP doesn't give me 1/2 the runaround that you do...

Humour me with an answer of what is going to happen. Tell me what you're planning to do so we can all move on and I can get closure.
Geezus, is it that hard? I know it's Friday and I know your bosses have a golf round to get to...

I don't know what's going to happen I'm afraid. As I've re-iterated, issues raised through ISPA, are handled by a separate Team that can best resolve the query using the processes that ISPA recommends.

Okay from now on this is how we will handle this...
Next time you ask me for anything, I am going to tell you to speak to my legal team, they are, by definition a separate team.
And, FYI, please refrain from blowing smoke up my arse... the complaint with the ISPA is closed off, unless, your "separate team" can't understand English as spoken by my me on the phone. Or maybe I must post some legal docs here on the forum... so we can see clearly who is lying!

Do you really want an adjudication?

Pay the guy and they won't - it's that simple.

It really isn't about that, the nature of the ISPA complaint needs to be resolved to both parties satisfaction. Our Team needs to follow the procedure and take things step by step.

It's called due process. If you don't pay your accounts and you get handed over you cannot simply go into Edgars or whatever and pay your account, because it now sits with legal. Now there are lawyers involved and everyone has to say their piece, once that is done an adjudication is made and the result will out. You cannot interrupt the process in the middle because you are in a hurry. You can't put toothpaste back in the tube.
