Am I liable for this??

Hey everyone,

On the weekend my dad was washing the car and my dogs were in our driveway with the automatic gate closed. My neighbor was walking her two yappers without a leash as she usually does while she lets her dogs run and taunt other dogs, so as we all know our gates have a gap at the bottom for the wheels.

As her dogs were barking down the street, it caught my dogs attention, so they came towards the gate. The neighbors dog stuck it’s head under the gate and my dog got ahold of the dog and bit it. You cannot see through the gate because there’s wooden slats.

Am I liable for this or is she liable for it?

Would think you are not liable. As the dogs came onto your property.

I would get proper legal advice as I would also think with the dogs being on your property you would not be liable.
*BUT* there could be a case for you/the property owner not fencing off properly (ie. the hole) that allowed for incident.

Yeah, I'm not sure what the laws are regarding leashing a dog, but being a responsible person, one shouldn't let dogs run around freely in public as far as I know.
