If I got a quote, and didn't agree to it, the last thing I'd send back is a thumbs up.

I remember having sent thumbs up to a 110K swimming pool quote received last year. I think we are getting ahead of ourselves. Just responding thumbs up is not really same as having oral contract. I asked for quote and he sent and I said thumbs up. There were 3 exchanges in total. "hi, please send me quote" , then "will do" then "here it is" then "thanks - thumbs up". How in the world this is same as me accepting a contract? What is the flipping need to have any contract at all?

Kitchen guy gave me a quote for R95k in Feb. He started late and was caught out by Covid lockdown, so only started again in August.

Lo and behold the top cupboards were 110mm short vertically. He tried to tell me this was due to a "change" not knowing that I still had the original drawings. I had in mind to pay him half of the balance due to assist his cash-flow, but this made me change my mind. He can wait for the R42.5k until my wife and I are happy

His cupboard joiner dropped his drilling machine on the floor, cracking a tile badly. That is another job. Luckily I have 6 left

I think the ANC just failed miserably to argue their case here, that's all there is to it, no way a thumbs up emoji is now the same as accepting a quote.

What probably sunk them is that they at no point objected when this company was rendering services, only to complain at the end when payment was due. I am sure the judge wouldn't be too impressed if you were all too happy to open you gates to the pool contractor, watch them build you a pool and you later object to paying them because you did not agree to any contract.

Well, it's seems the courts disagree with you in this case (which is admit-ably more complex than the examples we are giving each other there and there is more than likely more to it than a click bait 'thumbs up').

The precedent has been set by the courts.

Not really, each and every case has its own merits and it was way more than a thumbs up emoji that sealed the ANC's fate here.

If such a case ever arise it would also be argued on its own merit, a thumbs up emoji on its own won't suffice.

As I said the ANC failed to argue here, most probably because they are lying to start with, looks like their argument that the two officials were not authorized to enter into agreements was quickly blown out of the water, most probably there was evidence that they had entered into agreements before, there is no way that the TG can sign off on all financial agreements happening in such a massive organization, that's tantamount to saying everything happening at Eskom must be signed off by the group CFO.

All depends on what was discussed prior, and what sort of message accompanied the quote.

"We can start immediately" acknowledged with a thumbs-up emoji can cause a lot of confusion.

True, not like the ANC is being run like a proper corporate entity, I am sure some things are done in a very Comradely manner, as I said in the good old days this could have been sorted out in one dodgy way or the other.
