People think you go to court, win and then all is fine. At the end of the day you still need to get someone to physically go to the bank and do the transfer, and no matter what a court decides it doesn't physically force anyone to take that action. Unfortunately this isn't an episode of "Law & Order" or "Boston Legal". The supplier will never be paid and their business will be sunk.

I requested a quote to clear a plot of mine from a guy advertising bush clearing on Facebook. Received it and replied with a thumbs up as I was in a hurry getting to work. The next week the plot was cleared and he invoiced me. I paid though as I saw how that response could have been construed as accepting the quote.

If I got a quote, and didn't agree to it, the last thing I'd send back is a thumbs up.

They just ignore the rules and hope nobody notices. Mashaba took them on when they failed to R300k in legal fees they owed CoJ, going as far as threatening to attach some of their assets. They complied.
 
Make sure you get an invoice number for anything before you start the job or supply the goods. Without it their payments literally has no way to pay you because no number means no way to tie it into the books. They may want to pay but they can't.
 
Pick n Pay tried these strongarm tactics with me.
In 2009 we fitted 2 cameras at the entrance to their new family store in Plumstead. The manager was happy, he signed off on the invoice
6 months went by with no payment
After a meeting at PnPs Head Office in Kenilworth, they offered me 60%. I declined and said I would take it all out. Their reply was that if I stepped inside the store, I would be prosecuted for trespassing
I went straight to the store, the manager I dealt with was not there, but the maintenance fellow opened up the room where the DVR was. I told him I was taking it away for an upgrade and unplugged it
Two days later the manager calls me and says there is no picture on the screen.
I told him about the conversation at PnP HO. He called me 30 mins later and said it was a "misunderstanding". I waited 3 days for the full amount to reflect in the account before taking the DVR back

I heard from someone else that this type of behavior is not unusual

Any company that doesn't get a proper contract in writing is unprofessional, imo, and just asking for trouble. A thumbs up emoji? Really? I mean I'm glad the court ruled in their favour but really, who does that?
