Hi

I was wondering if some can help me out with this. I googled but having difficulty finding an answer.

So own an apartment that has a garage.

What I would like to know, does my garage door for part of the common area and if it does when it comes to the maintenance and the cost there of is the body corporate required to pay half the cost on the maintenance.

I am not clued up on the laws when it comes to sectional title laws etc

thanks I have no qualms paying half but getting my body coporate to pay half. They are saying that as not all units in the block have garages it would be prejudice against the owners of the units that don't have garages if they pay half.
 
Surely your monthly contribution would be higher, to cater for the half that they'd have to pay towards the garage maintenance? Same principal with people who have a garden vs those who don't

As far as I know all 1 bedroom apartments the levies are the same and 2 bedroom apartments are the same. That is the only difference in levie price, having a garage doesnt change the levie price in our block
 
i own an apartment with a garage and the body corporate paints my apartment (outside) and my garage every 6yrs as well as varnish my garage door. It is calculated into my monthly levy.

same doesnt seem to apply with my body corporate, sadly
 
That is bizzare. I was under the impression that i dont own the outer buildings and therefore it falls under body corp to maintain etc. I am only responsible for what is inside.
Saying that my geyser to blow up 7 yrs ago and there was water damage to the flat below me. Body corp insurance paid for everything, i even got a new free geyser.
I am sectional title, are you full title holder?

Then I'd think you'd be responsible for your own garage unfortunately.
 
my levy is affected where i stay, those that dont have a garage pay R120 less in levies per month

Where is your garage situated?

Mine is situated under the block don't know if that makes a difference?
 
mine is about 15m away, a row of about 8 garages.
Best bet is to chat to your neighbours there who have been there quite awhile

Sectional title act states that any door or window that divides the median between common property to exclusive use area needs to be paid for by both body corporate and owner.

Sounds very similar to the situation I’m in at the moment, had had numerous discussions with managing agent confirming Im happy to pay 50% and they need to pay the other 50% as per the sectional title act.

They keep sending me requests to paint I keep sending them the above. Been going on for about 4 months now.

It comes down to your exclusive use are, if your garage if for your exclusive use it should increase your monthly review. Likewise a 1 bedroom will be cheaper than a 2 bedroom

Physical location means nothing, all depends if it is specified as part of your section or common property. But even if part of your section 50/50 would be fair as the door is semi-common.

When we had sectional title, garages were part of a seperate building but each unit owned a garage. You were responsible for your own maintenance but obviously for appearance, the doors and roof were treated as common. All paid same levy though.

The “median line” in the context of the drafting of sectional plans, is not a physical thing. It is an imaginary vertical or horizontal line that represents the “mid-points” that are half-way between the outside surfaces and the inside surface of a wall, floor or ceiling, with one half of that wall, for example, on either side of the median line. In terms of section 5 of the Sectional Titles Act (“the ST Act”) where a door or window is set into an exterior section wall, the median line goes through the center of that door or window. The effect of this provision is that windows and doors (including garage doors) in the exterior walls of sections are always partially part of the section (the inner 50%) and partially part of the common property (the outer 50%). The intent of this provision is to make the owner and the body corporate share maintenance and repair costs equally.
