I know Apple fans lack all ability to think - but I thought that was when it came to technology. I didn’t think it was a blanket ‘not being able to think’

And you also feel that Apple patents are a bit much when patent colours & shapes - and uphold them? I mean they want to patent a photo of a fruit too. But I guess their founder wasn’t the most ethical guy himself and condoned stealing … no real surprise this is even happening

Apple is reportedly working to change the algorithms used for the blood oxygen sensor in the Apple Watch to skirt Masimo patents, with engineers aiming to adjust how oxygen saturation is determined and how the data is provided to customers. An Apple spokesperson said yesterday that Apple is planning to submit a workaround to the US Customs agency to determine whether a software change is enough to avoid an import ban.

Masimo would be open to settling its dispute with Apple to prevent the Apple Watch import ban that Apple is facing, but Apple so far has not expressed interest. "They haven't called," Kiani told Bloomberg. "It takes two to tango." Kiani did not mention the amount of money that Masimo would accept to settle, but he said the company would be willing to "work with them to improve their product."

According to Kiani, he has not spoken with Apple since 2013, which is when Apple considered purchasing Masimo or getting Masimo's help to develop the blood oxygen sensors in the Apple Watch. Masimo has accused Apple of employee poaching and patent infringement, and the U.S. International Trade Commission in October agreed that Apple has violated Masimo patents with the Apple Watch.

It doesn't really matter. The only thing of consequence is the actual patent. 99% of patents nowadays are probably worthless and only used to stem innovation. It's not patents that's the problem but that we don't have examining offices any more. I'm not against patents but basic ideas are not patentable and only novel execution of them.

From the sound of it what Masimo is alleging here is that Apple is violating its algorithm patents since the biggest part of biometrics is not actually the sensor technology which is pretty basic but the algorithms which interpret that data. What Apple is claiming is that they're not violating the patents in the way Masimo is alleging or that they're applying the patents beyond their scope.

Yes - there’s a 1% chance they’re sitting on a patent … and there’s nothing wrong with believing that. Realistically though - that’s probably not the case

Let me see if I'm understanding this correctly.

Apple wants to include spo2 tech in the Apple watch. Apple approaches Masimo (a billion dollar medical company) to use their tech. The talks don't work out so Apple buys a couple of the Masimo execs and engineers instead who implement spo2 in Apple watch. Masimo is now considered a patent troll.

Have I got that just about right?

Masimo are patent trolls. They filled hundreds of patent infringements hoping one sticks, and it did.

It’s just a money game they want a big payout. Biden should do the right thing and overthrow it but I fear he’s not awake enough to actually do it in time.

So it will probably go to a big settlement. Which is fine, Apple are big enough to handle it.

They should squash Masimo like the bug it is.

Yes it sits firmly in that space. They’re patent trolls and wait for someone to infringe for a big payout. This is not news lol.
