Article: Malema released on bail

Economic Freedom Fighters leader Julius Malema was released on R5000 bail early Friday morning after being arrested for speeding, Gauteng traffic police said.

"He was released this [Friday] morning just after 3am on R5000 bail," said spokeswoman Busaphi Nxumalo.

the primary purpose of bail is to ensure the attendance of the accused, it is inconceivable that Malema is a genuine risk of non-appearance. This sort of bull**** is just playing into Juju's hand. R5000 bail for speeding on the same night as a white celebrity gets R500 bail is simply unacceptable.
 
Released on bail at 3am..?? 3am, really? I thought bail was an order of court and I wasn't aware we had courts that were open at 3am.
 
No, the police station can issue bail.

They can? I've seen two of my mates arrested on a Friday and have to sit in a holding cell 'till the following Monday so they could apply for bail when courts reopened... No offer of bail from the stations they were held at.
 
Yes, but were your mates "high profile ... errr can't think of what Malema actually is :erm:

Depends on the charge. They have magistrates and prosecutors on standby too if it is bail the police can give

"Police bail" (s59) but at 5k I suspect it was bail by a prosecutor (s59A)

moreover magistrates can be woken up at 3am and nothing in the statutes would preclude his lawyers from threatening to (and going ahead with) bringing out of hours proceedings to the courts if SAPS persist in an idiotic detention.
