Article: Public Protector Thuli Madonsela unreasonable: minister

Public Protector Thuli Madonsela was being unreasonable when she decided to release her provisional report into Nkandla without obtaining comments from ministers in the security cluster, Justice Minister Jeff Radebe said on Saturday.

Speaking at a media briefing in Pretoria to clarify government's court action, Radebe said four working days was not sufficient for ministers in the Justice, Crime Prevention and Security (JCPS) cluster to peruse and analyse a 357 page report dealing with the R206 million spent on security upgrades to President Jacob Zuma's private Nkandla residence.
 
I'm not sure I understand. It's her report isn't it?

Do they want to edit it before its release?
 
Also, from things I have read it seems that Thuli Madonsela is one of the only competent people in government.

She's not in government. The Public Protector is a chapter 9 institution.

No, it's part of the investigation process that those under investigation be granted a chance to peruse the report and comment on it.

It's a State institution, but not part of the executive branch of the State. That's the whole point of Chapter 9 institutions, they're independent of the executive branch. Their existence is mandated directly by the Constitution.

The public prosecutor is though appointed by the president on the recommendation of the National Assembly.

So does the ANC get credit for this appointment?

Yeah, like first it was 'security updates' then 'operational requirements', still want to know how a cattle kraal figures into all of that.

The only transparent thing is how government is not!

"Johannesburg - Public protector Thuli Madonsela says it was a mistake handing over the provisional report on Nkandla to the security cluster ministers and that her gesture “in good faith” had been abused.

According to the Sunday Times, Madonsela said she would be guided only by the constitution and her conscience and that she was prepared to go to jail if needs be. She said the original agreement had been that the security cluster ministers would send a team to go through security issues. At no time would this team see the whole report.

She said she now realised the report should never have gone to the ministers.

It emerged last week that Madonsela implicated President Jacob Zuma directly in her report on the state’s spending of R206m at Zuma’s private Nkandla estate. Zuma had to date denied that the state had paid for the new homes on his estate. In an affidavit filed in the North Gauteng High Court in Pretoria on Tuesday afternoon, Madonsela for the first time said Zuma privately appointed the architect of the whole project.

This means that Minenhle Makhanya Architects from Durban, who earned more than R18m from the Nkandla project, were not appointed after a tender process conducted by the department of public works, but by Zuma himself."


Thuli is quite incredible. I just hope this standing up for herself doesn't bite her in the back, because we all know what cANCer can do to people.
