To be clear you are saying

1) flavours was copied ? - yet you can found loads of shops that sells these flavours as sodas such a local place called silk road at the coast.

2) catch phrases was copied ? - that's what the application was for wasn't it ?

3) bottles was copied ? - well not all of us has a proper vision I suppose and some might see same bottle looking at the two quite different ones.


That your points? I can agree on no2, but not with 1 and 3 as it's clearly different and taste can't be trade marked. Seriously the britians was already drinking dandelion and burdock as a soda in the 1265's, should I now toss away all my borduck stock ?

That said, Woolies have a long tradition of creating 'house brand' knock-offs of popular items - nobody I know falls for it - it's a choice - do I want genuine Toblerone, Sweetie Pie, Simba/Willards Cheese curls (yummy) or the Woolies clone? Make your choice

In my experience the Woolies clones always taste inferior (except for those pink and white marshmallows)

Woolworths is over hyped and over priced crap anyways.

Its not the taste or the product though, its the marketing. They can sell whatever they want as long as they dont rip off Frankie's marketing, which is what they did.
 
Reminds me of the fight between Apple & Samsung over their tab's 'round corners'. Hate it when the big guy uses its size to rip off the smaller guy.

LIO and Black Label were not competitors in the same market. No one will try to drink a shirt or wear a beer.

Yes, but there is a distinction to be made in passing-off (let people think the products is yours when it isn't) and misusing a trademark. Their are a lot of factors that need to be taken into account. Similarity and likeness do not necessarily equal infringement of intellectual property.

It is far more likely that people would be confused between Frankies and Woolies than between a beer company and a clothing company.

How much were the woolworths bottles prices at? the frankie's are like R11 a bottle!

There will always be differing opinions on whether Woolies copied Frankies or not. The bottom line is that Woolies were after that little piece of Frankies market.
Had they continued with the range, Frankies would most likely go bust, due to Woolies much larger client bases. 5 Years down the line, people would be thinking that Frankies is a Woolies knockoff.

As do other retailers. Why should only Woolworths be vilified in this case?
