Wonder who's going to cough up...

Should be interesting, considering that when you leave your car with them you sign something saying you don't hold them responsible.

Strange it hasn't been in the papers, wonder if Audi is paying to keep it out. (if it is true).

Within reason. They can put up as many signs as they like and make you sign as many discolsures as they feel like, but they are still liable AFAIK for negligence, regardless of what their stupid sign says.

For example, they cannot go and park your car unllocked in Hillbrow and then say it isnt their fault when it is stolen or broken in to. Regardless of size of the font they use on the sign that says "we will not be held responsible for being absolutely stupid pricks". The same way that they cannot take your vehicle racing without your express permission. They would somehow have to prove that racing the GTi was somehow integral to the servicing, and then prove that this is common practice for all Audi vehicles and service centres.

Insurance will cough up first, who will then sue the service centre for the full amount plus costs incurred IMO. Audi will gladly pay...

This would be a really interesting case to try in court.

Somehow I doubt that Audi Fourways would try and worm their way out of accepting responsibility for this. If they do, I will be watching it very carefully to see the outcome.

Wonder if he is still employed?

you know what the beauty part is ... they cant replace the car cause they stopped making them .... shame ... that's why I take my m3 in on a Saturday and wait for my car ... i know any performance car comes in it is driven like its stolen. imagine if the gynaecologist acted the same way when you took your wife or gf to them for a check up

Owner claims from dealer, dealer claims from idiot.

I dont think so.

Owner claims from insurance. Insurance claim from dealer, dealer fires idiot. The claiming from idiot part could get pretty messy but if they do have a legal claim against him based on his employment contract, then they should definitely go ahead with it.

But I am no lawyer, so not sure how the law caters for this...

By the looks of the pics the technician was trying to see if the traction control works. And he ended up in someone's wall.

There was a story a year or so ago on iol (AFAIK) about a guy who took his Jeep Grand Cherokee SRT to the Canal Walk branch for a service, he later logged onto Tracker and saw the log of the vehicle, the machanic was driving around in Table View going from 0 to +-220km/h and then hard breaking in a 60-zone.

He confronted the dealer who didn't do much, and the machanic was just given a written warning... I'll see if I can find the story.

EDIT
Here's the story, it was quite recent, I got one or two of the details wrong.
