It was enacted in 2013, but individuals, partnerships and entities have been given what some may call as leeway - It needs to be promulgated, and once promulgated there will be a 12-month grace period to be compliant with POPIA. In the interim, we need to rely on the ECT act, Section 14 and common law.

You can be broke-ass poor and some mobile communications company will still 'allow' you to be subscribed to some rogue WASP. Likewise with Hippo calling you when you open a savings account to drop your pennies in at your own expense.

Creditors... don't mess with them. The execution process happens quite quickly unless you act within the given time. Go ask any services provider how quickly they can obtain a judgement against you, and how promptly the creditor will instruct the sheriff to collect what the judgement states that you owe. Clerks of the court don't hesitate to sign the warrant of execution if they are provided with the facts (and merits).

You won't laugh when the Red Ants pitch up to take your movable property.

It is more of a concern for those seeking the court to stay or terminate the execution proceedings. The average citizen isn't Jacob Zuma.

Had a call from a debt collection attorney. Accused me of outstanding school fees. I explained he has the wrong Mrs Sollie (us being somewhat of an expert of who our offspring are). He insisted I send personal documents etc at my expense, also which he had no rights to. Told him to go get lost (in not exactly those words, a bit stronger).

Sheriff rocks up, impounds Mrs Sollie's car. Mrs Sollie and I go to said school. Investigation by school. Turns out said attorney is on school board and screwed wrong pooch. School apologizes, talks to attorney. Nvm costs for extra car while we could not use our own.

Yet Mr and Mrs Sollie the bad ones for not sending through documents, then later not paying court fees ... Mrs Sollie once again tells attorney to go get lost using words not befitting any institution of education. School withdraws case.

I have a good old legal friend who did just this for a living, and buying up property on the cheap :whistling:

Fair enough, wrong word choice. But in layman's terms, it's still pie in the sky and has zero value for consumers ;)

Reason for the delay is things like definitions of fire pools, other pressing needs to grease the wheels of the gravy train etc.

The riot stuff is never covered directly by insurers and instead is covered by Sasria. There is a small premium that insurers pay for this cover. Most insurers just pay your claim like normal and then claim back the amount from Sasria. So this policy is a bit strange as adding this cover is very cheap.

Doubt the nationalisation stuff will be covered by Sasria though as it wouldn't make sense since they are state-owned.

This. Both my vehicle cover and building cover have a separate fee for SASRIA. If the feral underclass does destroy your property, you have to claim under the SASRIA component (activate it if you don’t have it, it’s dirt cheap).

Looks quite standard. They may have labelled the second section Nationalisation, but I doubt any insurance policy covers you for asset forfeiture, preservation etc. The only extra term is potentially nationalisation. So they're just clarifying. Of course the insurers are being cautious. They make money by collecting premiums and not paying claims.

In the proposed scenario the number of execution instructions sought will be far higher. Those clerks will probably need treatment for severe carpal tunnel syndrome. Sheriffs will be running around trying to figure out what assets to take.

If you're struggling to pay your mortgage, you are screwing the bank by breaking your agreement.

Their long history is actually them just screwing you back...
Bullsh*t. There's no valid reason for selling a house for just enough to cover outstanding debt.
