Boot Configuration Data File is Missing

So I have a Toshiba Laptop with windows 8 on and I cannot seem to get this computer to get the file back or recreate the file.

I used the bootrec command but once i get to the /rebuildbcd it won't write it to disk.

Does anyone have an idea how i can install windows 8 if i don't have the disk and only have the partition because if I try to use the partition it won't write to the disk either :/

It sounds like you have a failing drive. Back up your data first then test the drive.

Ultime Bootcd is a good choice for diagnostics.
Start the computer and let it boot with UBCD. On the main menu is an option to boot into parted magic. It's a lightweight linux distro that will let you access the drive and copy your stuff to an external.
Restart the computer and boot back into UBCD then navigate to HDD -> Diagnostics -> Seatools for Dos.
Run the "Long test" under the "Basic Tests" menu.

I doubt it is the harddrive because it would go into the recovery options but just not allow me to recover the pc.

What i eventually did is remove the uefi and use the normal boot mode, the computer refuses at this stage to install anything in uefi for whatever reason.
