Cancelling a MTN contract

My brother took out a MTN contract under my mom's name two weeks ago. He subsquently decided to get himself killed in a car accident. Now I am sitting with a contract for a number that will not get used . I went to MTN and the response was that because it was in my Mom's name they can't cancel it. I understand this entirely and I am not bitching about that.
If i wanted to cancel the contract I have to pay the full 24 months @ the subscription rate.
She also stated that i cant transfer the airtime he gets on a monthly basis to my number.

I accept all these things above and understand it makes sense. But due to this forum being very clued up on CPA and that kinda stuff just needed a second opinion to make sure that the assistant at MTN was correct in her facts.

So other than selling the phone that is still intact, Is there anyway that I avoid spending as much as 24@ Sub rate?
 
The CPA has provisioning where you can cancel the contract without penalty. If your brother took out a phone you can have that returned as well as the box contents and negotiate that the account be settled pro rata and the rest of the contract cancelled. Get a signed letter from your mom about your brother's death as well as her approval for you to speak on her behalf to cancel the contract as it won't be needed (the CPA also provisions for this where goods or services can be returned or cancelled if they no longer serve the purpose intended by the consumer), and have a certified copy of the death certificate handy as well as certified copies of ID documents for both persons.

A police statement/case number will also help prove the legality of the reason for cancellation. MTN cannot require you to pay the full 24 months up front for a sim-only contract, not unless your brother took out a phone as well and subsequently destroyed it.
