Cancelling a vodacom cellphone contract

Pretty much everyone I know already has contracts, Over the last 6 months I have got my whole family over to VC with BB contracts to use the BBM instead of SMS's
I'd also like to keep the phone to use in Geneva, but its still cheaper to buy somebody a new BB and give them my contract.. just don't know anyone willing

how long do you have left? and what contract is it? cost per month?

The New CPA doesn't allow for contracts longer than 2 years. If you entered into a contract on or after 25 April 2010 that only expires after 24 October 2012, then you have a contract that is longer than 2 years and the CPA might be usable to get out the contract, or at the very least, reduce the duration of the contract.
 
Its the Blackberry Talk 240 BIS. If I remember right its about R435.00 a month.. Right now I am hoping that AniV is right at least and that something will happen after the 1st of April. Though I think people are going to be left in the dark for a few months while SP's continue to rape the last few cents out of people that they can. At least if I wait the last 3 months I have left it will drop the price by R1.2k for now

Your post doesn't make sense.

If I took out a normal 24-month contract on or after the 26th of October 2010, I would have effectively taken it after the 25 April 2010 and as it would expire after the 24th October 2010, it would fall under the Act.
 
The Consumer Protection Act will ONLY APPLY to Contracts/Sales/Purchases made AFTER the CPA takes effect on 1 April 2011.

You will NOT be able to use the CPA as an excuse to cancel existing contracts.
If you need to sign a new contract in the next while, I recommend waiting until after 1 April before taking up any new contracts.
Even a cellphone contract taken out on 31 March will NOT be covered under the Consumer Protection Act.
The CPA will not help anybody to cancel existing contracts of any sort.

Will the CPA also cover you if you upgrade your contract after the 1 April or is it just for new contracts?
 
Well I don't expect him to go against his companies policies, would just like to hear his view on this.
 
Hold on... the CPA will be effective on all products sold AND SERVICES RENDERED after 1 April 2011, so if Vodacom does not provide you with adequate service after 1 April, you might just ave grounds to stand on.

I'm pretty sure CPA only applies to new contracts. Today, when you sign any agreement there are either CPA clauses or a whole other CPA agreement you have to sign, even when taking a car to be serviced. Existing contracts didn't have those clauses so I think its safe to assume that the provider can't be held liable for anything part of the CPA.
 
to revive this discussion and to perhaps be assisted and offer assistance..

i am in the process of returning my phone due to it being incompatable to what i required it to do..

IE: low battery life, minimal functions and features and lacking in zoom etc on the camera.. it is also a cheap phone that i pay alot of money for for the contract.

i had just upgraded and complained withing the 10 day period within wich i had to do so..

i have been given the run around but it is due to them not actually knowing what to do.. anyway due to incompetence on their behalf i have asked for the cancellation of the contract and the CPA lays to be consulted in doing so..

lets see what happens ...

But onto another question- I have taken out a Smartdata 5Gb bundle thru Nashua Mobile at the special rate of R299 a month. This was at the end of November. However for the past two months (December and now January) I have been debited the standard package charge of R599, with only a single credit for the January amount. I may be pushing it, but am I allowed to request cancellation of this contract?
