Car accident query

Hi all,

please help me with this query: I'm using panel beater's car and caused an accident which was not seriously. Then the other car's driver wanted to claim from me. Now the question is if the driver should claim from panel beater's car's insurance, or from me. But I don't have insurance at monment, because my car is still in workshop.
 
He should be covered for something like this?

Otherwise he should have let you sign something saying you're responsible for any accidents etc.:D
 
6 year ago, a black male crashed my car and he just ignored all my "letter of demand"

I wasted more than R2000 for legal fees and R13000 for panel beater and R 2000 for towing etc .... at the end I never have a cent from that guy.

so simple .....

you know how to deal with it?

Look, I'm no lawyer but common sense tells me the panelbeater should not have let you drive off unless the vehicle was insured.

Have you spoken to them?:D
 
Yes, you should have signed something before you took the car from the panel beater. whatever that was, either said that you were covered by their insurance, or it said that you would have to pay in the event of an accident.

Sadly, you will probably find that any damage is for your bill and not that of the Panel Beater.
 
No you should say a guy crashed into me.

Don't stress though i always point out it was a black person but never do it as a white person but i am sure black okes do the same thing.

It bothers me that some seem to think this forum accepts racial slurs, there was nothing in the OP regarding the race/creed/religion of the other person in the accident so what's the point of making reference to it?

Anyhow back on topic, did you sign anything at the panelbeaters when you took over the courtesy car? A colleague of mine had to pay the excess on the prang, I would expect the same sort of situation if I was you.

As much as DreamKing's first post got a knee jerk reaction from me(you racist;) ).. The truth is, it's 100% accurate and not ofensive in any way, just descriptive.

And I think people is this country(including myself) are just too dam sensitive about race..

This is funny dude...car in for accident repair and you have one in borrowed car. Know its not nice....but still, Murphys Law...I had to have a little chuckle....

Now you know why you borrow a car from a Panel Beater at your own risk! :D
 
I am pretty sure that legally, the vehicle owner is responsible, unless the vehicle owner can prove negligence on the part of the driver, and then the vehicle owner can come after the driver as a separate issue.

That is why you walk out of a Car Rental place having signed many pieces of paper....

Highly unlikely that a Panel Beater of all places is going to be relaxed about lending a car to someone who hasn't been able to keep their own one straight, without putting the onus back on the driver.
