Hi guys,

Say hypothetically I were to smash into someone and I didn't have insurance, and the insurance company is now calling me threatening to take me to court. What would be the best way of paying back the money or seeking help in paying it back? Besides a loan?

I'm asking on behalf of a guy who is desperate and not lucky to have insurance and a forum full of knowledge

/inb4 how can he drive on the roads without insurance and he must now suffer

Crap, too late. :erm:

Seriously, even if you can not afford full comprehensive, get fire/theft/balance of third party. That way you are covered for events like this.

Negotiate seems like the the only option left if he doesn't want to take a loan. Hope he didn't crash into something expensive.
I assume it was his own car he was driving?

Has he admitted that the accident was his fault. Or is the insurance trying to bully him into payment since he has no insurance?

Be humble and negotiate with the lawyers. Do not let him be an ass about it.

Happened to me many many years ago, I was an ass about it, Cost me R4K (1/3rd) more than they were initially willing to go to.

Coughs. So what did you smash into. ? Coughs

best is to speak to the guy and ask to pay his access
Nope the insurer wants their money which is right.
All I can suggest is that you meet with them and negotiate. Every insurer handles recoveries differently and it's best your friend not play hardball.
Was it 100% his/her fault or could there be apportionment to blame?

Tell him to change his phone number and move. Also ask his employer to pay him in cold hard cash. Pull a full DB Cooper on them, they can't get their money if they can't find him

Kinda what I did.

No official job for around 2 years after that (cash only, no accounts etc, I completely forgot about it).

Moved back home, got a job and 2 months later, lawyers calls.

Would rather have dealt directly with the owner and pay for the damages. Insurance companies get ripped off, so he will most probably pay 3 or 4 times more for the damage now. What does the Road Accident Fund say?

"asking for a friend"

Ironically it was the guy smashing into me. We exchanged numbers and I thought it was minor damage, turns out it was far worse than I thought, but luckily insurance is paying it. He called me the other day wanting to get a second quote but the insurance had already started the repair process, and asked me for advice on what to do coz he didn't have that kind of money. I thought I would ask because I couldn't find any threads on it already

Let him arrange a payment plan with your insurance. If you deal with him directly, you open yourself up to all sorts of headaches and irritation, when you pay your insurer to deal with such things.

When something similar happened to a friend, the other guy arranged monthly payments, and when the total amount was paid back, my friend was reimbursed his excess.

Try not to get to involved. Ask him to contact your insurance and negotiate with them. This tends to bite you in the behind afterwards. This I learned the hard way. :(

Luck has nothing to do with it, at the very least he should have had third party insurance.

If you can afford a car you can afford third party.

But what's done is done. Best way would simply be to negotiate with the lawyers on an extended payment plan. Definitely don't get another party involved for a loan and even more debt.

****

Now you are the unlucky one having to deal with this crap because someone else didn't use their brain.
