I sold my car a few weeks ago privately and the buyer paid the full purchase consideration in cash but did not pitch up over the weekend to get a copy of my ID. My understanding is that the the vehicle registration can only be effected on presentation of both the seller and buyers ID. I did draft a simple sales contract signed by both parties but what are the consequences if the vehicle is still in my name and the buyer doesn't bother with the transfer?

Eh!... the way this process works..

You need to go to the Motor Licensing Bureau (where you renew the license), they have a Yellow form - Notification of Change of Ownership.

You fill it out, you get the buyer to fill out their section and sign it.

You take it back to the Licensing Bureau and submit it... your part is done...
The new "Owner" has 30 days to go and complete the transfer, or they'll have to go through a scrapping and re-licensing process.

(I Know this I recently sold my car, went through this and the buyer wanted a certified copy of my ID and I checked with the Licensing Bureau and they told he didn't need it, so I told him to take a flying leap)

Thanks for the reply, I was getting apprehensive about giving a total stranger a copy of my ID with the current enviroment (identity theft and all) and at the same time worried that the is still vehicle registered in my name. The problem is that I've been calling this guy for 2 weeks now and there was no answer.

Question: I sold the car 2 weeks ago so if I fill out and submit the yellow form tomorrow, is the effective date of sale tomorrow or 2 weeks ago?

Effective date of sale is irrelevant...

30 days from date form is submitted, but you NEED him to sign the form as well.. you can't submit it with his signature...

Just spoke to the guy over the phone and he said he submitted the form already without any of my input. Told me he registered in his company's name and he put my info/particulars on the form. Looking at the form (link above) it requires the seller's declaration and signature! Sounds dodgy, I'm going tomorrow to his place to pick up a copy.

The procedure is a little different between Cape Town and Jhb though... I bought my S2000 in Jhb, and a bit more paper work was required, whereas in Cape Town it was a bit simpler.

Phone the licensing bureau, as long as you know the license number and the details you registered under they'll tell you waht stage its in.

Fair enough,

I think that actually goes for any signature really...

Well, could someone enlighten me as to what happens in my case where I purchased a car from a private seller 4 months ago, and she has failed to fulfill transfer of ownership. The car is still in her name and she has my money, and after much ass kissing, still has not affected transfer of ownership

Its legally 21 days - not 30 days

Spot on! :D

BTW, having been in the trade, Licencing offices are not very careful about who signs the papers. That chap probably got someone to just sign your name, it will have gone through without a bat of an eyelid. Main thing is that it's out of your name now, so should cause no further problem.

I bought my car from my dad and now I need to go through this process as well. Does anyone know if I need to fill in the 'Organisation's Proxy' section on all of the forms? I would assume not

Depends. Are you acting as proxy for an organisation? ;)

are you a company/NGO or other such?

you will answer your own question...

Apparently I have to put the car through a roadworthy test as well as get a certified letter from the seller stating that he allows the purchase. Does anyone know if this is necessary?
