Car Purchased breaking down

Think its time you get a lawyer involved and insist on your money back... or at the very least, try the CPA

but dont accept the vehicle... remember, one day you'll have to sell it

I have a voice recording of him stating that there was work done on the front bumper but no big accident that could damage suspension/chassis

Then you have him dead to rights... he's lied through his teeth, he must refund you.
 
I spoke to the IDA (Independant Dealer Association) and he told me that if I am not 100% satisfied with the car, the dealer must try and get me similar deal until I'm satisfied. I am in the market of buying a car, but I'm just not 100% sure if I want to buy through them again. How do I know there's not something hidden? I guess you dont know. He then told me if it can't be rectified between us and I'm not interested in another vehicle within 14 days, they will refer the process to the ombudsman. I can also not say whether the dealer was aware of any of the information that I found out later, since this is what he states, but surely any good dealer will first get a total history of the vehicle before even considering buying it?

Try to get the dealer to give you your money back without getting the ombudsman involved. Or rather get the CPA involved than the ombudsman. Call me paranoid, but I have a feeling the ombudsman would side with him.

He cant say it has never been in a smash without investigating that fact first. Besides, you said it was sold from a scrap auction. Pretty obvious then. And it is definitely a code 3 - which I think he lied to you about too.

I think the CPA gives you the right to demand a refund so long as you do it within a certain time. At this stage a lawyer might well be worth your money. Present all the facts to them and maybe get them to write a letter.
 
Was definitely sold at a salvage and scrap motor vehicles - cheapies - non runners Auction. However, he's still says he didn't buy it from them directly, he bought it at another auction where the car was stated as a runner which might be the truth but this still does not help me since the car was first bought from the salvage auction.

He has lied to you already... words no longer suffice,... you want verifiable proof from an auctioneer that the car was sold to him directly as a runner.
 
no problems if the dealership has been paid etc.
I once bought an OPC from a dealership in fourways, look it back several times within the first 2 month coz of an engine light that kept coming on, and they couldn't fix it. in the end they offered to take the car back, and the banks sorted the money out etc.. i was refunded for 2 months of repayments. no cost at all to me!
I think that within the first 30days you are under NCA protection, and then after that to 6 months its CPA. I stand to be corrected though.
 
Hi everyone

So 14 days have passed and there are still problems with the car. I have contacted the IDA again and have asked for a refund and get the transaction cancelled on grounds that there are a few things that was not told to me by the dealer. What worries me is that the contract states that he can't confirm if the car was in an accident but when we spoke about it, he said that this car was in no accident and it was probably drivin into a curb/pavement where the front got damaged. However, I only googled the registration number and it was the first thing that came up!!

It was sold at the bank salvage centre. I looked at the document of all the cars and all of them are non runners!! Can anyone tell me exactly what type of cars get sold at a salvage auction? I googled salvage car and it says major/severe accident damaged cars. I also phoned them but they can not give me any information with regards to the car...

What numnbr did you google? Surely not the license plate number?
 
You won't believe it, but yes... License plate number revealed all... Even still on the web as we speak!!!

Quite strange. When I bought my car (2nd hand), it got a new license plate. Perhaps because yours came from an auction it works differently.

i always wonder why that sometimes happens as according to what i know the car keeps its license plate as all the second hand cars our family have purchased have.
 
So the woman handling the case gave me feedback and told me that the dealer do not want to take back the car. What do I do next?
She tells me it will be send to the ombudsman, but I really need advise now. Do I take it straight away to the CPA or what do I do?

who is this woman? imo you should be speaking direct with the dealership owner and failing that with your bank and or a lawyer.

you could also contact the motor industry ombudsman but you will most definitely be waiting for a reply.

if it were me i would be at the dealership with the car in the office with the owner and sales rep.
 
Contact the Ombudsman, as well as the consumer commission....

Then inform both the IDA and the dealer that you will be invoking the CPA and the car will be returned, and you will be expecting all your money back in full.... and should they "fight" you on this issue, you will bill them for costs as well.
 
Yeah contact both.

Just bear in mind - she says next step is the ombudsman, but the ombudsman does not overrule the CPA. They are still subject to it. At any time of your choosing, you can contact the CPA. I would do so now. Contact the ombudsman if you feel like it, I dont think it would do much good.
