CCMA / Labour Lawyer

Hence a letter from a labour lawyer ....

I've gone 10 years without warnings in my career and over a year at this company. This lady joins April and warnings follow in July, August, Sep.

So who is the CEO/Owner? Is he/she in on it?
 
Yeah I would also get with the CCMA BEFORE you get dismissed or asked to leave so that they are fully aware that you expect it.

Since you've already decided you don't want to work there anyway, going to the CCMA won't hurt you or your position as you expect it to disappear soon regardless.

So get your case to them before being dismissed and I don't see how you can lose.
 
Ok, so the first has expired.

Which makes me wonder how grievous missing an email deadline is that it warrants a final written warning?

Secondly, did you follow the advice to write an email stating that you would like assistance to remedy the situation and you need their help? This would then put the onus on them to prove they did everything in their power to fix the situation before resorting to firing an employee.

Edit: essentially to make you look good when going to the CCMA.

First is still valid until next month ; the sheer speed she is issuing these ;)

I was waiting for HR to send me the soft copy of the appeal and I was going to reply. However, 3 weeks and nothing...

So I sent today actually ; but not sure how it will look now the it's the same day of the warning. They may think knee jerk?

She's the new GM ; she is one under the big boss. Who knows what she has told the GM though...

She may be telling the big bosses what a troublesome employee I am

Keep your nose SQUEEKY clean, keep all documentation that you have.

If you have things in email or in written form that can show they changed the charge, the CCMA will have an absolute field day with them.

Note that once you start down the CCMA path, you can never go back to your current employer.

FWIW you may get on well with most of your friends/colleagues, but there will always be that special person who will have an instant dislike of you. The feeling may be mutual, or one-sided.

Not entirely true at all,

I've seen more than a few people return to their previous employer and stay there for many years afterwards with a decent working relationship.

If anything, if Dolby can prove in the CCMA that the new GM and HR person lied, and materially altered the charges, they may be required to undergo disciplinary hearings with the ultimate result of being fired since that kind of thing is an instantly dismissable offence.
 
That's a horrible situation to be in Dolby. Any idea what the woman has against you?

Does she want credit for cutting costs? Someone she wants to employ in your position? Are you easily replaceable?

Chances are she is trying to stamp her authority on things so the other employees follow her orders without question... and Dolby was picked as that person... may have something to do with him meeting targets etc etc and costing the company money without them seeing that he is bringing in the Sales to meet the numbers he is "costing" the company though.

Well requesting a meeting with her boss to clarify the situation and request an explanation cannot do any harm. If he supports her then at least he would know your side of the story and how you feel about the sudden change in relationship.
 
I should be meeting with a lawyer next week Monday. Without seeing anything, he's of the opinion that not much can be done :/

I am sorry but that is the same line we got from the lawyer we saw last year.

Best is, to follow advice given i.e. work squeaky clean, and find something else ASAP.

Most companies have people they hire on retainer to find loopholes such as this.
 
Maybe when he sees the warnings he'll change his mind :/ Sounded like a nice guy
 
I hope so, but I don't know hey, we went with reams of evidence to the lawyer we saw, and he said to us basically it is meaningless, and that in SA there is this perception the CCMA can help anyone for anything. The reality is, that the CCMA is only of use when there is genuinely a clear-cut case. They don't have the knowledge or ability to deal with cleverly crafted labour cases such as this one, especially when its an issue at corporate level.
