I won't pretend to know the answer, except that this is the verdict from many consultants we've dealt within the industry. By *we* I mean the companies I have been involved with since early 2011.
Most cases get thrown out anyway, someone is in a blue shirt, the blue shirt looks a shade of this colour here, another colour there. How can you be sure the blue shirt is not worn by anyone else?
Can you definitely, beyond dispute (law dispute) that person was actually there?
Etc. Really, CCTV is a tough, tough thing in court.
Unfortunately, it's beyond most to educate the court on the technical aspects, so they accept good and really bad evidence from both sides.
You can say "Oh, but I know this person, he works here" and he can simply plead the person looks like him and wore clothes that might have a similar shade or whatever. Those lawyers are really good at skewing things.
EDIT: I'm not saying cases are always lost, just that it's not necessarily worth it for the homeowner to pursue.
